Parking ticket in residential street with no bay markings - Newham - Grrrrr
fbreza
Hi
I received a parking ticket whilst parking on a road with no indication that it was a restricted parking zone.
I was under the impression that residential parking zones/ pay & Display had bays marked on the road.
The opposite side of the road had these markings, but not the side of the road i parked on.
There was sign on a lampost (i later noticed) but no markings on the road.
I have appealed, but they have refused to accept this. The letter I received back in response didn't mention my issue of road markings, only that there was a sign on the lampost..therefore they have refused my appeal
Am I in the right????

What did the sign say??I'd rather be an Optimist and be proved wrong than a Pessimist and be proved right.0

Pay at machine (display ticket)0 -
I would suggest that in informal appeal stating "the contravention did not occur" as there are no bay markings or lines. Expect Newham to refuse as they nearly always do. I would also post this as well on pepipoo.com for a balanced view.I'd rather be an Optimist and be proved wrong than a Pessimist and be proved right.0

I did appeal saying the "contravention didn't occur" and they turned it down

Looks like the road has been resurfaced recently and a bay only replaced on one side of the road as oppsed to both sides previously. See:

It's in a CPZ so anywhere that is not a bay should have a SYL. Additionally signs say pay at machine, but gives no indication which direction machine is (same on Shrewsbury Road) and on Google streets I can't see a machine anywhere either in Rutland or Shrewsbury.
It's unlikely the TRO has been amended since resurfacing, so wouldn't reflect what is actually on the ground now.0 -

Try pepipoo.com for this, they have guys there that can help for your formal appeal, really you are at the start of this not the end, so just register read tha faq and post a new thread with the links above, they will need to see the ticket both sides and the letter of refusal, just blank out all personal details.
Good luckExcel Parking, MET Parking, Combined Parking Solutions, VP Parking Solutions, ANPR PC Ltd, & Roxburghe Debt Collectors. What do they all have in common?
They are all or have been suspended from accessing the DVLA database for gross misconduct!
Do you really need to ask what kind of people run parking companies?0 -
Traffic Regulation Order which is a public document available on demand to view at the Council Offices and will specify all restrictions, layout, exact position of bays , SYL's etc. for that location. As i say chances are that it is different from what is actually on the ground now.0

There are 3 stages to a Council PCN appeal and Councils normally just arbitrarily decline at the first hurdle. They like to play a game of bluff and know that some people will just pay after the first refusal.
If you parked on the side with NO white bay lines then clearly 'the contravention did not occur'. Get advice from pepipoo as suggested but make sure you put in a formal appeal in good time, within the deadline, once you get the Notice to Owner. Pepipoo link:

If the Council decide to bluff even more then it's onwards and upwards to the adjudicator (an informal process, like a meeting & discussion about what happened). Councils often get close to this stage and then offer no evidence and fold, and if they don't then be aware that most adjudications find in favour of the motorist.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).
