    You said that payments sent as a gift are not covered. Would this be covered then? (It's the invoice that was sent to me)

    That looks absolutely fine.

    A gift is one where you pay the fees on behalf of the receiver of the payment. So if you sent money to an invoice or they sent an invoice to you, then you are fine.

    Ah okay, thank you. How long, in your opinion, should I give the seller to reply? He/she was quite prompt in replying before the payment.

  • I would email him and explain the the phone is misdescribed as you have found it full of text messages. Tell him you would like a partial refund (if thats what you want) or a full refund.

    Depending on his response, will help you decide what to do next. Just make sure you send it back via Special Delivery, regardless. That way, if you send it and he ignores you, you can open the dispute anytime up to 45 days after purchase.

    As it is the weekend, I would probably give him a couple of days. But you need to go by your gut feeling, but don't feel rushed, as you have 45 days. :)

    As far as I am concerned she has to make a decision whether to keep the phone and try for a partial refund, or send the phone back.

    Ultimately if she sends it back, she will be refunded.
