Distance Selling Regulations - Argos

I ordered something from Argos and paid a £5.95 delivery fee. When it arrived, it wasn't suitable, so I rang customer services who said they would could collect it for free or I could take it back to a local store. As I was in town today, I said I'd drop it back to store to save waiting in for a courier.

I thought under distance selling regulations I'd be entitled to the cost of the item plus the delivery fee back, but the lady in the shop said I was mistaken and I was only refunded the purchase price of the item.

Just wanting to check what the correct procedure is if you return an internet order under distance selling regulations.

    I am not a lawyer etc - but you are right... they should refund the delivery charge too...
    Retailers are also bound to refund any postage and packing fee on the original delivery.

    From Right to cancel;-

    "10. (2) Except as otherwise provided by these Regulations, the effect of a notice of cancellation is that the contract shall be treated as if it had not been made."


    Recovery of sums paid by or on behalf of the consumer on cancellation, and return of security

    "14.—(1) On the cancellation of a contract under regulation 10, the supplier shall reimburse any sum paid by or on behalf of the consumer under or in relation to the contract to the person by whom it was made free of any charge, less any charge made in accordance with paragraph (5)."

    Had the same thing happen in M&S recently. The assistant swore blind I was not entitled to P&P refund. I complained to their Head Office and got my refund and a £20 gift card. Don't let them get away with it.

    It depends on whether the original order was placed in store and how long you left it before you informed Argos that you wanted to return the item.

    If you ordered it over the Internet and contacted Argos within 7 working days of delivery then you would be entitled to your delivery charge back. If you ordered it in Store or left it more than 7 working days after delivery then you wouldn't be entitled to the delivery charge refund.

    Technically to qualify for DSR you would need to put your cancellation notice in writing (email or letter). I'm sure Argos wouldn't be this inflexible but it's worth remembering to do this if you deal with a less reputable retailer as they could argue this later down the line.
  • The order was placed on the internet on Sunday night. It arrived late afternoon on Wednesday. I rang Thursday and said it wasn't suitable and took it back to store on Friday morning. Certainly within 7 days.
