Am I correct in thinking that in order for section 75 to be applicable in this case the transaction needs to be direct with the airline and not through a travel agent that then pays direct to the airline??

Yes, the only party you can claim it against is the company who accepted your card. I guess if they are desperate enough, they can take your money, but need to provide the service (tickets) as well. What do you have on paper (the confirmation letter/email)? Does it have the exact prices, and not mentioning extra charges when paid by different methods? Does it mention what you are getting and when?

If you have that, you can tell them to provide the service at the agreed terms, or your bank will do the clawback for the full amount, and you don't need to contact them again (just make sure you have everything that happened recorded in some way).

I'm afraid there are too many things this can depend on for us to give better advice...
    Enjoy the silence...

Thanks for the advice - we will go direct to the CC company. The Travel agent we used was part of the Polani Group - Flightcatchers.com, Comefli.com

to all readers please stay clear of them

You will need to pursue the vendor first.
I would suggest a letter by recorded delivery.

Incorrect, the credit card company will encourage you to do so, and will be unwilling to get involved, but if Section 75 applies they will (legally) be jointly or separately liable ith the merchant.

The Credit Card company saw that the bulk of the money had been refunded and asked us why the full amount hadnt been returned.
They asked us to contact the travel agent and ask them why they hadnt refunded and send a copy to the CC company.

The travel agants response was - if we want to get legal they will charge the whole amount again!!!!!

As you can imagine the CC company loved the fact that potentially an authorised payment could be processed again.

We will keep the forum posted on what happens - but we anticipate having the remainder funds returned soon. Hooray!!
