    Good luck, and stay strong, he's getting away with murder, totally messing all of your lives up by his irresponsible attitude to financial and family responsibilities, please take the actions we have outlined and whilst it will take time, things will get sorted eventually, as long as you stay focused - you have rights and should put in the departures, plus legally be entitled to 50% of the rental.

  • Hi all me again!

    I have just received a phone call from ex OH MIL {who has been very supportive to me and my girls} to say that my ex OH had been contacted by the CSA and wants to put his mom and dad's address down as where he is living!

    For whatever reason he is not telling them where he is actually living {even though I am almost certain where he is - the CSA have the address} My ex is weaving another web of deceit but......

    My question is, assuming the csa believe him and assess him will this have any implications for my M and FIL? .....and now I know, will they view this as fraud??? at this rate he will be residing with HM, I suppose that would work in his favour as he he won't be liable! Oh this is getting too much now...help pls

  • If he's not giving his real address - sounds to me like he's dodging other people! If his OH is receiving tax credits, they would be very interested to know that her boyfriend is residing with her. The CSA can trace address through electoral role but if he's dodging it, they may not be able to.
    If it is CSA 2 - it won't matter a jot that he's living with a partner as they won't take her income into account. It will be based on a percentage of his earnings (including tax credits).

    You would have had to sign a document covering the loan. Do a basic Subject Access request on the mortgage and the loan and see if you think you actually signed the documents involved.

    You are legally entitled to see all documents that relate to joint accounts.

    I have got a copy of the original loan document - for all intents and purposes it looks like my sig except I don't think it is.......

    Yep you are right, but it is his mom and dad that I am worried about, they are quite elderly and open to abuse he's already stolen money from them. I can't stand by and watch them get in to trouble for thinking they are helping him...and in in turn his girls if you get what I mean.

    Well it was in 2006 and I can't remember signing this particular form, however I would remember signing something if I knew it was for nearly a hundred grand and I would be 75 when it was paid off.

    I think he has forged my sig...again how do I prove it, I have been to solicitors and qualify for legal aid for the divorce {they said they can't help me with anything financial} So I can't see the point.

    Why cant the solicitors help you with anything financial? You CAN get a decree absolute without full financial disclosure but many judges will not issue one without financial consent to both parties.

    When did you find out about the loan? Surely a loan of that size would need a witness I would have thought......or did he just happen to turn up at the bank with a signature??

    I think you need to seek financial and legal advice, in my experience (supporting people who have gone br), the official reciever will often offer half of the house to the other partner if the house is in negative equity. Was it offered to you when your husband went bankrupt? If not then I would be asking why. Also you should be getting 50% of any revenue because the money should be going to your order not his. CSA payments are exempt from any bankruptcy orders so he hasno leg to stand on, he should be paying you based on his income regardless, any other payments come from what is left and deemed suitable by the OR. As for the laon why should you pay £40000 that you have never seen?

    As for his parents, being honest if you have his work address give that to the CSA dont let his mum and dad use their address. If they are elderly then he may well flannel them about what they need to do but if letters and compliance officers are turning up at work it may spur him onto do something ;)

    As for protecting a future asset - the family home should be divided in the divorce settlement so it sounds to me like he is trying to pull a fast one. You should get at least 50% of the equity in it (and so 50% of the rental income etc) and possibly more if you have been at home with the girls.

    Sorry to be brutal but you need to toughen up, and stop being nice or he will walk all over you. If you dont like your solicitors - get a new one. I interviewed mine, he was most taken aback but we got on like a house on fire after that :rotfl:Its your girls that need support now, and if your eldest wants to go onto uni then she needs help in the next few months not in 25 years time.
