Help regarding Triton/Tesco card

Almostbankrupt
My partner has a Tesco master card with a limit of £3500.00 which is over limit by £365.00 , she ignored it for a while but has now been contacted by Triton collections who will only take £650.00 per month or it goes to court and will hear of no other offer , now , the debt was at our old address which we moved from 6 months ago , they dont have our new address although ( thanks to our " helpful "postman lol ) The default notice and subsiquent letters still made it to us .She ( i think foolishly ) made a payment of £70.00 today directly to Tesco via on line banking , i reckon that'll dissappear into the ethos as the account is no longer in Tesco control, But , what happens now , can they take her to court even with the wrong address ? dont they have to attempt to come to some sort of suitable arrangment ( which she is perfectly willing to do btw ). Could anyone please give me a little insight into how this all works please .?:(

The "duck and cover" approach is fairly futile I'm afraid when you start updating other credit cards / bank details / council tax over to the new address. The DCA's can and will find you fairly easily.
First and foremost you need to send Triton the prove-it letter (someone on here will post the link in a minute) to make sure they do actually own the debt.
Then you have to bear in mind the following:
1. Never, ever contact a DCA by phone. Ever. Not for anything. Just hang up if they call you. If they pester you (and they might) there are various letter templates on here to help put a stop to that.
2. They can't have what you don't have so if you only have £6.50 left after paying all other priorities, that's all they get. They might think that you should be living on cold beans and value bread for the next 50,000 months to pay them back but that's because they believe the universe revolves around them. It doesn't and you should be able to put food on the table and a roof over your head first. They actually come fairly low down on the list but they don't like you to know this.0 -
Thank you for the swift reply . I figured the " duck and dive " approach to be futile ( having been here myself ,, i was declared bankrupt on 26th March 09 ) but i didnt even realise there was a problem till it was too late . i found the " Prove it " letter but am unsure if it applies in her case as she is quite happy to admit the debt and attempt to pay it off , although i still think sending £70 this morning to Tesco was a huge mistake .anyway , Her total debt is around £15000 ,, way too little to go bankrupt on and i cant find any decent solution for iva / dmp over here ( in NI ) they all want to charge around 6000 to do those , wierd , and not at all helpful. so , im not too sure how to approach this , last speak with Triton they were filing for court , probaly might as well write and ask for the original cca and give em the new address eh ???0

Its not about admitting the debt, its about whether when you signed up the CCA was correct, they do have rules they need to adhere to.
For the sake of a letter to see whether the debt is enforecable surely thats worth the possibility that it isnt and cannot be enforced thus saving you £15k.I all have learnt is from others on many sites.
Seek legal help if unsure.
Dont pay Private Parking tickets - they are mere invoices.

Here is a thread that has info about debt solutions in NI https://forums.moneysavingexpert.com/discussion/2744014 (Unfortunately, it seems that debt relief orders are not available).
Your OH should be seeking advice from CCCS who are free (link in the thread above). The £70 may not be lost if Triton are managing the debt for Tescos (instead of buying the debt from them). They should be making a payment offer in writing of what they can afford after taking into account the other debts as well (there are standard letters on national debtline website for this).
I think if you tell them you are seeking advice, they have to hold action on your account for 30 days.0
