Land Registry plans

We are due to complete in a weeks time and we've run into some trouble regarding the loft conversion in the flat we are buying. The vendors do not have any accurate drawings of the area since it was converted, only basic plans that have no dimensions and do not show the full living space correctly. Our solicitor now has the task of presenting these to the Land Registry and whilst he is hopeful that they will be accepted, I can't help but feel that we should be submitting more accurate plans in order to avoid complications further down the line.

I do not feel it is our responsibility to pay for more accurate plans to be drawn up especially as the conversion was done two years ago and should have been submitted at the time. However I know that the vendors have been hard work to date and will want to avoid paying for the plans themselves at all costs.

Does anyone know how detailed the drawings need to be for the Land Registry to accept? Also are we in any position having just exchanged to get the vendors to pay for new plans to be drawn up? Many thanks.

  • You need to be more precise as to what document the plans are to go in.

Is the lease being varied to include the loft or a new lease being granted to the seller?

Is the footprint of the loft different from that of the flat below it or exactly the same?

If the loft has always been included in the area covered by the lease then making an internal alteration to insert stairs of partitions to divide up rooms inside it may not interest the Land Registry at all.

As a retired conveyancing solicitor I believe the information given in the post to be useful assuming any properties concerned are in England/Wales but I accept no liability for it.
  • Hi,

The plans are being submitted as part of the lease. When the conversion was done the loft area was never included in the lease as being part of ownership of the first floor. The property is a victorian conversion and is share of freehold.

We are now having to submit the plans along with an updated lease to prove that we, as the soon to be new freeholders of the first floor, also own the loft space as well. I hope this makes some sense!

The problem is that the only plans that exist are the architects plans from when the conversion and these are so basic that I'm worried that they won't be accepted.
