Cabot Financial - !!!!!!?

In late 2005 I was declared bankrupt.

I owed money to CitiFinancial on a credit card.

On 19/9/10 I received 2 letters, one each from CitiFinancial and a company called Cabot Financial, both in the same envelope.

The CitiFinancial letter said they had 'sold' my account to Cabot Financial.

In the other letter ,from Cabot Financial, they are asking me to provide them with details of the Official Receiver, Bankruptcy Start Date, Bankruptcy Order Number and Court Name.

Surely CitiFinancial will have this information from when the OR processed my case.

I am minded to ignore these letters, what good will answering them do me?

Advice please.

  • Cabot have clearly wasted their money buying that debt;) serves them right.

    I guess they want your BR details so they can send the debt back to Citi.(maybe they get a refund for buying a dud debt LOL) You can send the details or send the stuff on to the OR office & see if they will send confirmation.
  • Refer to the sticky on clearing your credit record post br, it's probably still showing some of the debts you had when you were declared br and these can be sold on.
  • Just had the same myself, BR and dischaged in 2007.

    The legaslation of lawfull assignmants states it must be something in action, ie a live account, as the debt was written of at the end of your BR it is no longer in 'action' therefore can not be legaly assigned to anyone.

    Ignore or tell them to stick the assignmant up there !!!!!......your choice ;)

    Furthermore, ignoring and/or disregarding claims that debts have been settled or are disputed and continuing to make unjustified demands for payment amounts to physical/psychological harassment.

    In addition, your continued telephone calls are in breach of the Office of Fair Trading guidelines. If you continue with them after the receipt of this letter an official complaint, together with a log recording the times and frequency of the calls will be passed both to that office and to the Trading Standards office.

    This type of debt collection method is contrary to the ‘Administration of Justice Act 1970’ in that it is intended to cause alarm and distress to the recipient. Your methods will not be tolerated. A formal complaint will be submitted to the relevant authorities. This will be relevant to questions of your fitness to hold a licence under the Consumer Credit Act, whether or not it results in a prosecution.

    Take further note that continued telephone calls after the receipt of a request not to call may constitute a criminal offence under Section 127 of the Communications Act 2003.

    I love it! our OR told us to be careful of people trying to do this sort of thing and to make sure you list all your debts as they can try and claim you owe the money years down the line

  • Myself and my husband were discharged from bankruptcy in 2009, we both received the letters from Cabot yesterday, you try and put it all behind you and then you come home to more letters. I rang them last night and gave them the information, I also told them that I have checked my credit report and citi marked the account as settled with a zero balance. She said to be honest we were not the only ones contacting them with the same situation. As they requested I also said the same in an email and asked them to email back so I know they have sorted and to telll me the matter is closed. Will this ever end:mad:

    I had this letter yesterday as well for a Citi debt that was included in my IVA which was finished Jan 2009 and my credit files shows this debt as " settled " and balance of £0

    I gave my IP a ring and they said they had a number of calls about same thing appears Citi had not cleared these debts off their system and then sold them on to Cabot.

    I did ring Cabot and spoke to lady who took details and said that it would be passed back to Citi and that no record of Cabot being owed money would be recorded no credit file.

    I ahve also followed this up with email containing the information given by phone and asking for confirmation when this has been sorted.
    TOTAL 44 weeks lose. 6st 9.5lb :T
  • I never thought about Cabot registering the debt. I had earlier in the year Hilleseden Securities registering a debt they had bought from one of my creditors, I contacted them and they marked it settled.
  • I got one myself 2 days ago, am discharged from bankruptcy in 2009, first letter I had in ages, was somewhat suprised, have emailed them the details
