If the OO was gas safe registered at the time he fitted his own boiler then he was covered under the law. If the boiler hasn't since been checked by a gas safe registered HE then the buyer's solicitor will ask for an indemnity policy or the buyers may prefer that the vendor gets it properly serviced by someone who * is* currently gs registered and hands over the evidence that this has been done,the op poses an interesting point,
the actual statutory provision states "competent person"
now consider this
a previously corgi registered engineer <deemed to be competent, no time limit> who allows his registration to lapse <by choice, not removal> installs his own system in his own property <fully legal>that he then chooses to place property on the market.

GASSAFE gas engineers have to sit onerous exams on a regular basis to remain current and competent...
but you are right.. there is a loop hole in the regs re consumers choosing their own engineer for work on their own home...0 -
If the boiler blows up damaging the neighbour's property, or the gas leak poisons the neighbours then the homeowner can face problems. So while you can get anyone you like to install your boiler in your home, if you injury someone else then expect someone to try and sue you.I'm not cynical I'm realistic

The normal criminal law would also come into play where it could be applied.
The only real difference is the lack of duties placed on householders by various bits of Health and Safety legislation.0 -
As Duncan303 says, you don't need to use a GAS SAFE engineer - you need to use a COMPETENT PERSON. Gas safe registration is the preferred and most commonly used proof of competency but not being registered doesn't mean that you aren't competent or are working outside the law.0
