insurance company CAN THEY DO THIS

hi I have had a tv damaged by a person who came to fit a patio door.I am going trough thier insurance company allianz.my tv cost £950 but because i have now replaced my tv which cost £549 thats what they have offered me.can they do this.

    If they can purchase a TV of similar spec to your old one for that price then i think it would be reasonable.

    Depends on the age of the TV and the spec. Prices have dropped a lot over the past few years, LCD TV's
    used to cost £1000+ but you can get them for under £300 now (32").

    So its quite possible that is what your TV is worth now. Recently my FIL was told not to buy a TV today
    come back in 2 days, It maybe on sale. Saved him £150 on the same TV.

  • thanks for your quick reply.but no its not because of age of tv as i only bought it in march so it was only a month old when it got damaged its because i have bought this one so they have said thats what they will pay me. this one is no where near the one that got damaged its just i couldnt stand not having a tv.I think i have been stupid in telling them that i had bought a new tv but didnt think they could do this but it seems they can

    think you should have borrowed a portable in the meantime....if you have replaced your tv already you may find their not obliged to give you the difference in cash....now had it been settled beforehand and they gave you £950, you're probably not legally obliged to buy a TV at all...

    Personally, I wouldn't even be claiming off the builder's insurance. I would have written to him asking for payment and let him make the claim himself. If this didn't get anywhere, I would have sued the builder for the value of the TV he broke.

    They do not have to give you cash at all. You are entitled to a like for like replacement. In other words, they must supply an exact replacement or a model of equivalent (or better) specification (if the one you had is no longer available).

    Presumably you don't want this as you have a new TV. They know this and are trying to reach a deal by offering you £549 in cash. If you negotiate with them, you may be able to get a little more money out of them, but be careful as they are perfectly entitled to just send you the replacement TV. If they are a big insurer, they probably have a deal with an electronics supplier, so it will cost them less than the £950 you paid to do so. You bought it in March, so if that model is still available now, it is probably cheaper than £950. Then take of the VAT, then whatever sort of discount you think they might get from their electronics supplier, and that is the point at which it is not worth their while to make a deal and instead offer you cash.

    Actually they do, if the claimant desires, albeit the value based on a like-for-like replacement. Also the OP should be aware that they don't have to replace/reimburse on a new-for-old basis, they may take into account the age of the damaged TV.

  • thank you all so much i cant tell you how much stress this as caused.I have had the biggest problem with the insurance company allianz who i have never heard of. This claim as been going since april i was dealing with a man at first who diddnt seem to no what he was doing then i was told he had left now im dealing with a lady ? who as lied to me and the people who have got my tv they are based in leeds and have told me they have sent queot for tv repair but this lady said that they had not you no what i mean i could go on they also have not paid the tv repair company for picking my tv up i have sent a letter of complaint on the 2 september but still no reply
