Contract Obligation with Large Kitchen Company

I signed up to a large premium kitchen company for a new kitchen around a year ago. The process of events was that a designer visited our house, designed a kitchen, then offered a huge discount if we signed up there and then. Given that a kitchen was a priority we agreed and handed over £500, at this point we had not signed any contract, and understood that we had 5 days to cancel or the deposit was non refundable. Since then a turn in circumastances has delayed the project, however further research on the Web has changed my mind about proceeding with the project and the quality of the kitchen company. We have reached the point whereby a surveyor has visit our premises and drawn up a plan. Again we have not sign or retained any form of contract with clearly stated terms and conditions. The original order has also changed due to stock availability. We have also not take receipt of any goods from the vendor. My question is if we have the right to terminate the order and what the conesquences would be? I appreciate that the deposit is non refubable but would like to know what the likelyhood of being able to cancel the full order and walk away.

    Without a contract document it would be very difficult to determine if there is a repercussion from cancellation.
    It is questionable whether an agreement exists at all although clearly money has changed hands and you verbally agreed to something.

    Legally it would probably come down to what you said, what they said and the opinion of a judge if it was to go so far.

    You mention a change in circumstances delayed things. Who instigated this you or them?

    I would probably phone them tell them you are thinking about cancelling the project (and to halt all work until further notice) and ask them to send their terms re cancellation. Ask for a copy of the contract at the same time as you were not given one when the agreement was made.

    Once you have that if it goes beyond your £500 deposit then consult a solicitor as to the enforcability of those contract terms.

    You seem to understand the deposit was non refundable after 5 days so that is fair enough and as you have pointed out the loss of this does not concern you (to much).

    Anything further however is very much on the table as I presume:

    1 Cancellation terms were not explained to you

    2. You never signed an actual document agreeing to those terms.

    Finally please try and post in a larger font many will be unable to read it.
