Moorecroft Debt Recovery Question

We're in the process of doing our own DMP and coming away from the CCCS. My husbands new job after being made redundant now pays on the 26th and making the payments to the CCCS on the 1st is coming increasingly difficult.

I have contacted all our creditors and they are more then happy to receive the monthly payments from us via standing order on 26th.

However Moorecroft Debt Recovery (we have a debt from Lloyds loans for around £13000 which is now with MDR and we pay them around £190 a month) has told me that we cannot pay them as the payments need to hit our account by 23rd of each month. When i said that the CCCS payment doesn't reach them until the 25th of the month I was told this didn't matter and if I started paying on the 26th they would take us to court to recover the full amount.

Can they do this?

  • If they still recieve the money before months end and you are still paying and not behind at all what are the courts going to do it could be just hot air it will cost them to go to court

    Typical DCA attitude really.
    Moorcroft are rotten to the core.
    Its not for them to say how much you should pay them & when.
    They have no legal power to any money off you whatsoever - only a county court does.
    These clowns wont take you anywhere near a court as it will cost them money to do so.
    Not sure why you are paying them £190 per month anyway? - this is way too much in my view...if you are happy to then so be it, but be prepared for more treatment like this in the future, the more you carry on paying them.
    The fools shoot themselves in the foot anyway - they have someone who is seemingly happily paying per month, yet when something doesnt suit them - they get all nasty & threaten court etc..
    Well if it ever went to court, the fools might end up getting £1 per month or nothing at all - would serve them right.
    Report them to the OFT & trading standards if they carry on being funny with you...:mad:

    They are simply full of hot air & threats that never turn into reality.
    I had Moorcroft on my case a few months ago - soon went away when told in no uncertain terms what was what etc...

    The £190 is what the CCCS awarded them out of our £320 DMP payment. I am happy to pay them that amount, but I wish to pay them directly instead of through the CCCS as it would be easier to pay on 26th when my husband gets paid rather then faff around trying to pay on 1st.

    I was told standing orders take 3 days to clear so I have to pay on 23rd or they will get all upperty. I'm sure we can work around to paying them on 23rd without too much hardship. But you'd think they'd be happy that I am actually paying them regular installments and haven't missed a single payment.

    Its upto you when Moorcroft get paid, not for them to decide when they do - if they get all upperty then tough on them.
    I wouldnt be paying these goons anything at all personally as they have no legal power to any money off you....
    You are right in that you'd think they would be happy to have someone who actually wants to pay them - but this is the wretched DCA industry we are talking about here that is never happy & likes to think it has control over the individual at all times.

  • moorcroft must be the worst company ever, my brother has a debt with them and he has to pay by the 13th of each month, he goes to their office and pays cash usually near the start of the month however, if he pays on 12th/13th they will send a letter saying he has missed a payment when he phones them up to tell them he made the payment they will say 'it takes a couple of days to register on their system' his reply get a better system! another trick of theirs is to send a letter telling you they have increased your monthly payment 'so you pay off quicker' clowns!

    I wouldn't even waste the stamp on the postage to them, pay them on the 26th as you've informed them on the phone, they will accept the payment;)
    Their threats of court are as pointed out just 'hot air' and are trying to bully you:(
