  • Had the same problem, paid them 5 days later than they wanted... they sent a grumpy letter saying I'd defaulted on the payment and they were now asking for full settlement of the entire debt...

    and I've continued to send them the same amount, on the same 5 days later than they requested and recieve the same grumpy letter and I've never seen the threatened court letters!

    They are bullys, but not sticking up for the other poster but we have seen a rise of agencys taking people to court as its their only choice.

    Even if they do take you to court they won't be awarded anymore money. You will get a chance to state your case and show what you can afford to pay. And if the judge sees that you have paid every month up to the court date he won't be very impressed with Moorcroft.
    Pay on the date that suits you, not them. They'll whinge but treat them like you would any other whinging child- ignore them. Don't let them think you are scared by their bullying tactics and if they phone you do not speak to them. Ever.

    There is no logic in a DCA taking anyone to court - firstly it costs them money to do so & then the person being taken to court has basic legal rights/protections etc...
    So if anyone can point out what good it does for a DCA taking someone to court then please tell me..... :)

    But on a serious note and to answer the question - pure profit.

    If it is profitable for them to take you to court then they may do so.

    If they think it is more profitable to hound you to death (i.e you show you don't have much consumer knowledge and they think they can bully you into paying, and will see a faster 'return') then they will do this instead.

    Ultimately they are businesses, and conduct their 'activities' to make money.

    The problem they face is that more and more consumers are starting to become aware of their rights (thanks to sites like this!) and are standing up to them, hence an increase in court activity.

    In this case though, with payments being made historically too, I personally think a judge would take a very dim view of litigation for the sake of a when in the month you are proposing payments.

    I appreciate what you are saying S & V - but it still doesnt answer what practicle good it does them?
    You say for profit, but nobody turns up at a court & simply hands over x hundred/or thousand pounds there and then.
    There is a legal proceedure that has to be gone through before hand & only then does the issue of how the person repays come into question (if they have to repay at all)
    So even from a business perspective - it does the DCA no good at all & in most cases will leave them worse off simply getting the person to court in the 1st place.

    No thats exactly right, and also why its such a rare occurance, because it generally only happens when it does make business sense for them (which as you state in most cases is not very often at all).

    They are looking at the return over the long term in these rare instances and so will balance up the risk/reward equation (and in most cases risk will far outweigh the reward which is why they don't bother).

    And for some of them they have to think long term because the future is not looking rosy for some of them at all! :D

    In the OP's case I think the risk/reward equation is weighted far too much in the OP's favour for court action to happen. But as said since when did you see logic in a DCA?!
