MBNA Reclaiming charges

Can anyone help? I'm trying to retrieve a substantial amount of charges from MBNA from 2 credit card accounts I had with them. I sent my £10 cheque for each account 3 weeks ago, and have just phoned them to ensure that they have received them and that they were processing my statements. I have twice been told that I would have to pay £2.50 for each statement and that they will not entertain the £10 payment for all statements. I politely discussed with the tele-sales gentleman that I would be proceeding this in a court of law as I was entitled to the statement data. At approx. 13:29 this afternoon he told me that 'that wasn't going to happen', and he hung up on me.....i am quite sure that these telephone calls will have been recorded????
As you can imagine I am both angry and a bit stuck now!
Can anyone advise?

    Data protection applies to data that is in an ordered/ indexed data store. The problem that a fair number of people on here recently have reported is that not all card issuers store historic data in this manner - many use microfilm which is not covered by the data protection release. For your £10 they should send you copies of everything that is held on computer but are under no obligation to send anything that has been archived to film so it may be that they only have 12-18 months on computers. If you want any of the data that is now on film the only way to legally obtain this is to pay the £2.50 per statement - to be honest this is a very low fee considering the effort it takes to actually retreave film from off site storage and then find the relevant statements to print.

    yes they will and in fact they have too as they are charging you. Be nice though ;)
