In theory, if there is no ROW and i errect the fence on my boundary, is there anything stopping me adding a "private property - no tresspassing" sign on the side of the fence that faces him?

Nothing to stop you putting a sign up, though it should be unnecessary.

Of course, if you put up a new fence, there's nothing to stop him taking his down and claiming the land right up to your new fence. A second fence is rarely a good idea. If you want more privacy, you may need to be more imaginative. You can put up some tall posts with wires between them and grow something like Mile-a-minute Vine or Clematis montana between them.

If you have only moved recently, I would have thought any right of way over your land would have had to be declared. Why has he got a gate onto your front garden? Maybe it was from a time when he was on good terms with the previous occupiers. First thing is have a good look at your deeds. You are supposed to have planning permission for fences over a metre which face the road (though we have a huge fence and have not had a problem), but I would think a 2 metre fence between properties would be okay.

Alternatively, grow a small bush to provide some screening:

i think the fence is there from when the houses we're first built and people actually got on with each other and had communities...sadly its not quite like that anymore (well not for me!).

Dig an eight foot deep pit on your side of the gate.
Place some sharpened bamboo spikes in the bottom.
    Cover with some loose brush.
Drop neighbour a note instructing him never to use the gate into your garden.;)
