TOWER CAPITAL have tricked me

Hi
OK so basically I have an ongoing dispute with TOWER CAPITAL LIMITED, I took a payday loan out with them some time ago & I defaulted on the payments.
I asked if I can pay £20 per month (£250 outstanding balance) and they said that if I increased the payments to £50 per month they would not take any further action (meaning no register a CCJ against me!)
So I set up a standing order thinking everything was OK with the payments, my first one came out 1st September ok and cleared, I then receive papers from the court about a CCJ being registered against me, I had filled in forms I had received from the Money Claim Online that they did, but they said I should fill these forms in and send back and then if I keep to my £50 they would not register a CCJ against me, and they have done.
I am really angry about this, and they just don’t seem to be helping me, I have evidence that they have said this and confirmed to me many times that they will not register a CCJ.
I feel tricked and deceived by them!
I have put in a complaint with the Financial Ombudsman and also have sent a letter to Northampton Court with emails from TOWER CAPITAL attached.
What else can I do to get this CCJ removed?
I am desperately trying to clear debt and get back on straight and this has really set me back a lot!
Thanks
Vicky

This is what they have said and I have sent this to the courts and the FO (dated 23rd August)
They have just emailed me saying they will accept £150 settlement figure, but this is not through the Courts, I think they are taking me for a ride & as a result I have a CCJ registered now!!
We cannot cancel a claim, however should you not make payment as agreed we will then apply for a full county court judgement. You currently do not have a full CCJ, as mentioned below the claim registered against you had had already been done. BY increasing your offer to £50 per month, we agreed that we would not apply for a full county court Judgement
If you can make a one off payment off £155.00 on your next pay day we will accept this as a Full and final settlement, we will then get in touch with the courts and advise them that this matter has been resolved. This is a concession of £175.00

Sounds like they haven't done it yet so I personally would just pay up and move on.
Have you checked your latest credit report at the two major CRAs? do you know if there is an actual CCJ registered against you yet?"We want the finest wines available to humanity, we want them here, and we want them now!"0 -

I'm a bit confused about this. What do they mean by the fact that they have not registered a 'full claim'?
Do they mean that they have actually applied to the court for a CCJ but if you cough up then they will withdraw?
Have you actually been served papers from the court? Have you called the court to confirm?
I don't disbelieve you it just smells a bit fishy from the description given so far and companies have been known to send letters pretending to be applications for CCJ's etc.

Have you actually received a notification from the court that a Judgement has been made? If not you probably havent got a ccj so as has been said, if you can, pay up and move on and get these scumbags out of your hair.
And never, ever take a payday loan again. Cos if you do, this is what you have to deal with, as I know to my cost.

Hi xvickyx
Can you (removing any personal details that would identify you and any other personal info) post up a photocopy/scan of the court letters etc?

Main question:
Have you had court documents or have you had a cunning document made to look like a court document sent to you?
If they were court papers (you mention mcol) I assume you filled in and sent back a sheet within 14 days to say you had received the claim including admitting you owed the money or a defence? You sent that to the court, yes? What then came?
I'd be questioning if their emails achieved anything within the Fraud Act 2006. Especially if they were stating that if you paid them money they would not go to court, then did so (i.e. satisfying the gain/loss element). I'd be hard pushed not to press the FRAUD FRAUD FRAUD button on my keyboard...oh whoops, I already did.0 -

Hiya
Yes I received the court papers and replied admitting to the amount owed, which is what Tower Capital told me to do (at this point I had already made a £50 payment to them starting my installment plan!)
So when I get back off holiday I had some more papers that are titles "Judgement by Admission" which is still a CCJ, and then it is detailing the repayments I should make, but the amount is wrong as I had already made a payment before the court even agreed the payment plan!
I sent the papers back thinking nothing woudl come of it, as they said they would not register a CCJ, which seems that they have.
I have checked my CallCredit report and no CCJ is showing up yet![STRIKE]£9,336[/STRIKE] Current Debt: £8,635
