Neighbour Dispute.. really need help :(

Neighbour Dispute.. Can anyone help :(
There have been an ongoing neighbour dispute for 6 years, the neighbour turned a carport into a bedroom which is attached to my gable end. This carport was already there when i purchased the porperty but now the neighbour has turned this into a room. There louge is at the same level as my bedroom as they have a 3 story house, all this work was done without planning or building regs.. because of the time limit the both planning and building regs cant do anything. I have so much noise coming from the neighbours. I have twins who were 3 months premature and i wanted to sort this out asap. The neighbours agreed to put in sound proof after knowing this was going to court and my solicitor said that because of the time scale it would be unlikely that i would win and may even lose my house. I signed an agreement for sound proof and the solicitors cancelled the court hearing.
What happened is that they have put in sound proof but the noise is still the same.. blasting music, doors banging. and this is waking my little uns up and its breaking my heart seeing them so tired but yet still cant sleep. I have my tv on subtitle if they are sleep. But all this noise from next door is making them jump. Would this agreement be void. Please help!! K

    What do environmental health say about the noise levels?

    And keep it a little noisy when they are babies as they learn to sleep through noise then. Silence and then noise will disturb but background noise plus a bit extra shouldn't.

    Ive just recently phone the Enviromental Health Department. but im not sure if they would do anything as i signed an agreement stating no further action can be taken toward this neighbour dispute. I was pushed into signing this as my solicitor said its either i lose my house or just sign it. And solicitors took loads of money off me. :(

    Its more of like a banging noise and music.. everytime they band the door it vibrates into my bedroom and wakes me up aswell.. im really concerned about my babies as they are rubbing there eyes and seem very uneasy.. ive seem them jump afew times with the banging. :(
  • Whatever you signed with the solicitor, AFAIK, has no relevance to your problem now. You have nothing to lose going through the council route and ultimately it could reduce the problem. You already have a problem should you come to sell the house so if you feel unable to talk directly with your neighbours, then go the council route.

    Thank you for your reply... it makes me cry seeing my babies at 9 months getting restless. im hoping the council do something as they didnt help at the time of the conversion, they said he had planning but he didnt. i paid these solicitors over 10 thousand and they wasted time as there was a time limit on a neighbour dispute case and the only reason why they thought i would not win is because of this time limit. having no planning or building should have won me the case alone. I really did not want to sign this agreement and now i wish i did not as the noise is still the same :( ..
  • I agree with the others, they will get use to the noise over time, its like living in the flight path to an airport, or even next to a large motorway / railway line.

    You could provide some background noise for them, in the form of leaving the TV on in your bedroom, or even a small radio.

    You could move bedrooms, or even move them away from the wall which the noise is coming through. I would not worry about the noise if they are 9 months old now, it wont be long before they are gaining there legs, and throwing toys over the baby gate.

    But why should they because the neighbour is playing loud music? Report them to Environmental Health. Work with them and do everything they tell you and either your neighbours will be a bit more thoughtful or end up being prosecuted by the council. Either way it should solve the problem.

    I know it'll be expensive, but have you thought about soundproofing from your side too?

    How was it proved next door soundproofed theirs? Surely there was something written into the agreement about it being done professionally, or for noise levels to be checked after.

    Maybe they're fed up of hearing crying babies next door. I know that can't be helped, and I know it's not what you want to hear, but maybe it's turned into a vicious circle as they turn the music up to drown out the noise. If the walls are that thin, they must be hearing it quite clearly.

    What's the layout of your house like, as someone said above, can the babies move into another room?

    I do feel for you, I really do. It's a horrible situation, but try to find a way round it so it doesn't stress you out too much. Also agree with what was said above, babies need some sort of noise. Can't see that a deadly quiet house is of benefit to any of you - I'd certainly keep the television's sound on!

    Thanx for your replies.. This was a on going dispute where the neighbour turned a carport into a room and using this as a study. this is above level not ground level. The wall is connected to my gable end and they didnt get building regs because it wouldnt have passed, as their lounge is now on the same floor as my and babies bedroom.. ive got a music box which i put on when they are getting tired and come to think of it i do leave the tv on some volume but still with subtitle, as i have difficulty hearing from my left ear. i have place a thick headboard but still the noise is still there.. this conversion had been built against my gable end. I cant place soundproof on my side as the room is too small and will not have enough room to get pass from the front of the bed. they did tresspass, ive lived with it for a long time. instead of going to court for tresspass and noise because of this tresspass, we all agreed that they would place sound proof but still it seems to be the same, they have not tested it in my room, i have asked him but he got very agressive. i do feel as i shouldnt have to live with it as it was the neighbours that built this without building regs and as its been over 2 years they can not do nothing. i cannot move rooms as i only have a 2 bedroom house and both rooms are connected to this conversion. The noise is like someone is in my house and im constantly checking the wardrobes and each room.
