Paypal -counterfeit item/dispute process/chargeback

Hello. Can anyone advise me with a rubbish situation I placed myself in. I purchased an item which appears to be fake. I have sent it to the manufacturer for written confirmation that it is. PayPal who carried out the payment transaction- have asked for written confirmation of the fact it is fake.
I don't imagine this being a problem. Does anyone know that it's true what I have heard that..... even if PP find in my favour that if the seller has withdrawn the balance of their PP account, I could get nothing?
I paid using a Mastercard and I have heard that trying to get Mastercard to instigate a chargeback is impossible. I would have been better paying with a Visa debit card for chargeback purposes.
Any advice would be appreciated. One last thing, this was not an EBAY purchase. It's from a website that is still operational this morning. I believe the website has been opened for the purpose of selling fake goods. I don't want to say too much more at present as I don't want them to get a heads up that the authorities are now (hopefully) looking into them.
Cheers!

Paypal protction covers all purchases both on and off ebay. The rules have changed so that a refund is not dependent on a seller having funds in their account.
One word of warning though, the timescale for proving to paypal that something is a fake is very tight, you must get the letter on headed paper to them usually within 10 days, exceed their time frame and they will merely close the case.I’m a Forum Ambassador and I support the Forum Team on the eBay, Auctions, Car Boot & Jumble Sales, Boost Your Income, Praise, Vents & Warnings, Overseas Holidays & Travel Planning , UK Holidays, Days Out & Entertainments boards. I recently sold a genuine Louis Vuitton bag to a buyer in the US. I have the receipt and any LV store would confirm authenticity. However, the buyer decided they would try and commit fraud by claiming a refund based on the item not being genuine. I received an email from paypal advising of the claim, then a minute later I received another email from Paypal saying they had closed the claim because they do not get involved in "authenticity queries" and that they are only concerned with non-receipt.
I have been using ebay for 9 years and had two claims through paypal myself for non-receipt in that time and both times paypal have refunded my money because the sellers did not send the item tracked.
So, in my experience, paypal are unlikely to be of help to you in your situation.
I would start a claim through your card, regardless of the rumours you have heard, then if paypal come through you can always cancel it.0 -
That is incorrect as the OP has already been asked for written proof that the item is fake. Paypal frequently take on fake item claims on ebay. They give the buyer 10 days to get written proof from a manufacturer or shop that the item is fake. If the buyer supplies this they will be refunded. It's as simple as that.LilyDeTilly wrote: »So, in my experience, paypal are unlikely to be of help to you in your situation..
There are several reasons why a section 75 chargeback is likely to fail via paypal it makes sense to wait for the paypal outcome before considering this. Why complicate matters further.0 -

That is why I said "in my experience" meaning my opinion is based on my experience with paypal so far!!0 -

Thanks very much for that advice. I feel better now. Once I get my refund, I will name the website so that others will know not to purchase anything from it.
Bye for now0 -
Yay!!!!! Fred Perry have now supplied written confirmation that the polo shirt I purchased from https://www.avfashion.co.uk is counterfeit.
I had missed the 10 day deadline because FP were a bit slow. But for some reason PayPal have granted me a six day extension.
Even if that fails - I am on first name terms with a manager at Clydesdale Bank Card Services in order to do a Mastercard chargeback.
So trading standards, its over to you. I will be making sure I get updates from you regarding this retailer.0
