Service Charges in Commercial Property

Hi, I dont know where to ask this question, since there is no commercial section. A good friend of me is getting stung for a 40K service charge to fix part of the roof of a property where he has a 50% lease. He is 1 year from the end of the contract and has only been paying 4K a year because the the property was empty for 10 years prior to him making it usable 4 years ago. It appears his solicitor did not add a service charge cap because the owner replied to a question saying the 'service charges would be minimal'. Is there anything he can do to avoid paying this? He is only just breaking even as it is and any extra costs like an expensive commercial lawyer is out of the question. It appears the owner is taking advantage and trying to screw him over.
