90 days notice to cancel a Direct Debit???

Hello,

I pay for my son to attend Martial Arts class but we wish to stop these now. I ahve tried to cancel the monthly payment but the company that manage the payments say I have to give 90 days notice to cancel and they will continue to take the Direct Debits monthly until then.

What is the comeback if I simply cancel it with my bank please?

    You can cancel the Direct Debit mandate (but the company may simply try to restart it - although I don't think they are supposed to do this).

    Even if they take the money, you could claw it back through the Direct Debit Guarantee.

    However, if you are obliged to give 90 days notice (after considering any agreement you have, the Unfair Contract Terms Act and other regulations) you will still owe them the money whether or not they can take it by Direct Debit.

    Have you got any terms and conditions from the provider of the classes? These should cover cancellations and make it clear whether you are in fact able to cancel at shorter notice than 90 days.

    Hoping you might also be able to help me!! I'm also having trouble with a Martial Arts club with the 90 days notice!
    Cancelled with the club in October, just after the October payment, was never advised to put this in writing and in all honesty never thought (stupid me) I let the November payment go through as thought it was 30 days notice then cancelled the DD.. again never wrote to the DD company as stupidily never thought!

    They are now taking notice as the 15th December and chasing for payments up to February! Spoke to the club who have been very unhelpful... asked for a copy of the contract which we received on Sat... this looks to have been our copy (members copy)... should we not have received this in the 1st place?

    I'm really MAD!! is there anything I can do about the dates, my word against theirs, but should I not have been told about putting notice in writing? Should we not have been provided with a copy of the T&C's?

    Also if we are having to pay up to Feb does this give us the right to then take him to classes until March? Not that I want to do this but will so I can make sure other parents are aware of the 90 days notice... I do feel this was mis-sold!!

  • Always put it in writing or email. Also most school clubs run for the term, so in essence, they are there for the term.
