Job Offer withdrawn...... please advise

    Missing the point.

    Even WITH a written contract, they can get rid of you at any time in the first year with no reason; and unless you can prove discrimination you have no redress.
    If you haven't got it - please don't flaunt it. TIA.

    Within the last week I have received three separate emails from the NHS (via their recruitment site) advising me that jobs I have already applied for have now been withdrawn.

    Yep, same thing happened to me twice within a year - same job in the same department. I think because of the redundancies and redeployments this creates. While disappointing, I already have a job, so understand that someone who is about to be made redundant should have it.

    I think you are missing the entire point here. You cannot force somebody to employ you if they do not want to - not matter whether you have an offer of employment or not. There is no right to compensation for having not been seeking other work during the time you have been waiting - that was your choice. You could equally have found another job during that time and given back word - it cuts both ways.

    If you can evidence that you had an unconfirmed offer and that you were not given notice before your agreed start date, then you may be able to make a claim for any notice pay for the period of notice which would have been within the paid period of employment. But I am not hopeful, and if you do, you can be pretty certain that you won't be getting any future offers from the same employer.

    If they are advertising externally then apply for any of them that you can reasonably do. Once you get your foot in the door then would be more able to move between departments :)

    Would you think that if:
    • You were an existing employee being made redundant, aware that at exactly the same time as making you redundant your employer was recruiting someone else to do a job that you were perfectly able to do?
    Or if:
    • You controlled the purse strings (or were a UK taxpayer funding public sector jobs) and were aware that you were making a redundancy payment to someone who could effectively be transferred into another existing job?
    It may seem ridiculous from your point of view, but unfortunately for you, this isn't all about you.

    This directive has probably not come from HR, or if it has it will have come from the very highest level. They know they are going to have large budget cuts in the next few months. They know they will have to make a large number of staff redundant in the near future. They have not yet made you a binding job offer. By offering the job to someone internally, they will be saving money as that will be one less person who they have to give redundancy payments to.

    That logic doesn't help you, but it makes perfect sense.

    Well..........

    I had a 'word' with a couple of employment law solicitors who advised me I definitely have a case here. I then had a further word with the employer and lo and behold they have called me back and confirmed me in the position, starting soon.

    Seems you guys don't quite know as much as you think ;););)

    Remember this is a board where people just give their view and you are quite within your rights to go and get other views but also bear in mind that they may just be back tracking to cover themselves over something and if you suddenly find 'its not working out' then if it is within the first 12 months it maybe quite hard to take them to a tribunal.

    Well I'm glad it worked out for you - if indeed it has.

    Keep in mind that you have very few right during the first year so, if they feel they have been forced into hiring you to avoid some possible claim, you will need to watch your back!
