Refund Problems

Hi all,
I purchased a Macbook keyboard online to fix my Macbook that has broken. After the keyboard arrived stright away I noticed it was not the same colour. And would not fit, as well as being a used Keyboard. What I was not aware of at the time.
I contacted the company and got told that is the correct part after sending them picture they agreed it was werid it didnt fit and was the correct part.
I told them as it did not fit and was not the same colour and used it was no good to me and I would like to return it. They told me this was possible but I would have to pay £20 + postage for restocking the item.
Can they do this ?
To me it seem unfair and alot of money since the keyboard was £60 its 30% of what I paid for the keyboard.
I done some reasearch online and found [FONT="]“[/FONT][FONT="]Under the distance selling regulations, you are quite within your rights to change your mind at any time within the first seven days, return the goods and get a full refund. This means without financial penalty of any kind – such as a cancellation charge or a ‘restocking’ fee.”[/FONT][FONT="] what I sent to the company.
They replied saying [/FONT] [FONT="]we supplied the part you requested, we have no need to refund at all.[/FONT]

[FONT="]Can they do this too not give me a refund?[/FONT]

[FONT="]Am I best just to open a paypal disbute with them and let paypal resolve it?[/FONT]

The DSRs are correct. The restocking fee is contrary to them and they have no legal right to charge it.0 -
It seem a bit unfair as on there site there is no refund policy explaing this. Does this mean that company can charge what they like as restocking Fee? I do understand the point of a restocking fee but 30% for him to unbox it and put it back on the shelve. Seems very expensive most places charge 10%.Hi, we’ve had to remove your signature. think a name and shame if only to serve as a warning might be appropriate....don't have a go at them, you may find when you post details...others have had similar problems.I'm now a retired teacher... hooray ...:j

They cannot charge you a restocking fee. DSR's give you the unconditional right to cancel. Providing you notify them of your intent to cancel within 7 working days of the contract being concluded.
They may require you to pay return postage, but you must have been given this in a durable form as pre-contractual information (website isnt durable but email is).

Where do I stand then as they saying I have to pay £20 restocking fee or I cant get a refund they also expect me to pay for postage back to them too. What can I do about this?

Hi all,
Need some advice about this I open a disbute with paypal, what has been a big waste of time. I am now without £60 and no part too. They said they can not do anything what makes me feel like using then to buy online is waste of time. And I should go to a shop next time as I could have returned the item with no problem.
is there anything else I can do ??

The only realistic option available to you now is to file proceedings in the small claims court. But I would also contact Trading Standards as this company are acting illegally.0
