Orange Contract Cancelation can i keep the phone?

Hi my contract started in february 2010 and i've been havinf signal problems at my home and all the way down my street. I've called orange and given them plenty of time to try and resolve the issue but they haven't so i called them and told them i wanted to cancel. They said i can't so i quoted the sale of goods act, a product or service must be fit for purpose and i explained calmly and nicley that I am not happy with my service and i want something to be done or i'll leave and I have every right too. The lady on the phone went away and talked to a supervisor and asked and he said orange are merging with tmobiles network (so both can use each others) so if i waited till then and it wasn't good enough then i could cancel but i'd have to send the phone in. They also said they would pay for this months bill (since i have to wait to see if they can find a resolution, which i am happy to do and i am going to give them plenty of time to solve it else i'll leave). To be honest i'd happily stay with orange if I could get signal anywhere on my street with the new tmobile network share but if i have to cancel then my question is can i keep the phone? Am i long enough into my contract now that it belongs to me? Am i right in thinking the phone is a gift the contract is for the service not the phone and after a certain number of months i can keep it?

Well you got the free phone on the ground that were going to have the phone for full contract perdiod which they've let you out of of because of the bad reception in your street. Which they don't need to do btw as the phone works and reception can be affected by lots of unforeseen things. Them letting you out of the contract if teh phone is returned seems fair enough to me. You've got no legal rights in this case and SOGA wouldn't apply to bad reception as long as the phone works.0

why would you want a phone locked to Orange when you say you cant use the service?
you didnt complete the contract terms so you dont get the phone0 -

I think it might apply because when i called the terms of my agreement it was under the condition that the new phone (knowing that there was a problem that could have been the old phone's fault) would be able to have better signal.

Well firstly it's not very hard to unlock it from orange and the reason i would want one is that I still need a phone . . .
I heard somewhere that the phone is a gift, not part of the contract. However, if that's not the case then it's better sending it back because the phone was playing up and was starting to become a hassle itself but hey it's better a phone than no phone (i didn't want to cancel really because i've had quite a good experience with orange, they're always very happy and cheerful)
