Returning Goods

In June this year I bought a new Khyam Freelander tent on Ebay at a cost of £170.

On receiving the tent and erecting it for the first time I noticed a number of flaws and contacted the seller by email to advise. I included pictures showing the problems. The seller apologised and promptly sent a replacement tent.

The replacement tent was used for the first time last weekend (2 nights). I now find that a tent pole has split. Given the problems I encountered with the first tent and now a further problem with this second tent I want to send the tent back for a full refund as I have no faith in the quality of the goods.

The seller now says "Sorry we would not offer a refund on a broken pole as poles are not covered under warranty see Khyam for the warranty on poles we are happy to send a pole section for the pole to be repaired as we do on all Khyam warranty's and we send pole sections out at a charge for the pole.you may send the pole to us to repair if that helps"

Am I entitled to a full refund? Is my wish for a refund worth pursuing?

I will be grateful for advice on this.

  • If it is just the pole that 'bent', try asking for a replacement pole. If the ten it self is faluty, and you bought from a UK company, SOGAs applies.

    If it were a private seller, one assumes goodwill applies, as I think (Do not quote me on this) the 45 day paya dispute rule.

    The company has already said it will replace the pole however as this is the second tent from the same company I have real doubts about the quality of the goods. It cant be reasonable to say (as they did) that pole problems are common. I have had a cheap tent which has been well used and not had a single proble.

    You'd have to rpove its unfit for purpose under soga for a refund take your new pole and sell the tent and buy a different brand

    However, I am confused as to why, when an integral part of a tent is broken, the goods cant be rejected.

    Without the poles the tent is inoperable.

    Grateful for any advice.:)
