Can someone please answer?

Does anyone know if Insurance companies can gain information from the council regarding who pays council tax at certain properties or is this under data protection act.

    Why would an Insurance company want to know who pays council tax at a property?

    I just can't see them asking but if they did they would not be provided with the information (data protection) unless it was from a public register that you had consented to.

    I can think of the electoral register, for which you receive a note every year, asking who lives at the property and there is a tick box, if you don't want the information to be made available publicy. But I am not aware of council tax payers info being released.
    The comments I post are personal opinion. Always refer to official information sources before relying on internet forums. If you have a problem with any organisation, enter into their official complaints process at the earliest opportunity, as sometimes complaints have to be started within a certain time frame.

    A council tax bill satisfies one of the requirements for anti-money laundering checks. So, they could hold a copy council tax bill on file, if provided by the client to the insurer or their broker/adviser.

    Thats about the only time I think they would have any interest in seeing it. Although a possible fraudulent claim investigation could throw up information as part of the investigation. Some of that information may or may not be important to the case.

    Anyone can get access to who is on the electoral roll. That's not exactly the same as who pays council tax, but the electoral roll is available to anyone unles you specify you want to be on the "edited" register, which means it's restricted to certain authorities like the police.

    With regards to council tax then we wouldn't release info that is identifiable - if they came and asked for a total of how many single person discounts there were in a postcode area then they would be given an overall figure but if they came along and ask does numer 25 have a discount then they would not be given the info.
    I no longer work in Council Tax Recovery but instead work as a specialist Council Tax paralegal assisting landlords and Council Tax payers with council tax disputes and valuation tribunals. My views are my own reading of the law and you should always check with the local authority in question.

  • Yes, they can. If they require the information for the purpose of intended or current court proceedings, they can request details under S35 of the DPA. If they require the information for the purposes of detecting a crime (including dealing with, say, a fraudulent claim), they could request it under S29.

    Some local authorities will provide information upon production of a compliant request for information. Others require a court order.
