overdraft/seperation

Just a quickie thanks.

I have a joint account with my soon to be ex husband. We have an overdraft facility and are currently into that overdraft.
I do have my own current account also.

my question is do we have to clear the overdraft before I can have my name taken off the account.

Its an ultimate reward account with Halifax.

Ive tried ringing them but I have now had 2 different answers! Is there anyone sensible out there who can tell me?

    The overdraft will most certainly have to be settled before you can close the account. If one person become bankrupt, vanishes etc then the bank will pursue the remaining party for the whole debt.

    Is your other account with Halifax or any of its group of companies? if it is they will take funds from that account to cover any short fall in the joint account.....I'm not kidding.

    If this is true, get another account with a non connected bank pronto.

    yes I have a current account with halifax in my name also. Im doing dmp and sorting out myself.
    I have opened a new current account with Nationwide and am in the process of switching all my stuff over.

    I work in a bank and the first thing you need to do is talk to them. If they are happy that your ex-husband's salary etc will still be going through the account they may be happy to remove your name from the account and let overdraft remain in his name. Either way you both need to sign a letter stating that your aco!!!! be removed from the account.

    having seen this situation numerous times I would suggest closing the account and repaying the overdraft if bank are not willing to allow your name to be removed. This still requires both signatured and you would be amazed at the amount of people who think their name has been removed when the other party has not signed anything!!
