banks mistake what happens next???

Hi this is my first post so bear with me 
I had a phone call from my boss today to tell me that their bank have paid my wage for july into my account twice.
I check online and sure enough i was out the problem is i didn't notice and i've spent it. :eek:
Apparently the bank wil be contacting us all soon to ask for the money back - is that legal and what rights do i have regarding repayment to them?

You didn't notice? come on please. I wasn't born in the gas works and left to dry on the canal tow path.
How could you not notice that you had double wages?
Anyway, you have to legally pay back this money, there are no loop holes and no regualtions to save you. I would talk to your boss and at best see if you can pay it back monthly or something.

I am pretty sure that's legal. Its unfortunate that you are in this situation but at the end of the day it wasnt your money and worst is that you have spent is. Unfortunately ignorence that you didnt notice wont help much either.
However as it was the bank's mistake hopefully they may be willing to discuss a repayment plan with you. however dont expect to get away with paying £1 a week or soemthing crazy like that...
just wait till bank contacts you and it will be advisable that you start thinking and acting toward paying that money back..0 -
Legally its pretty clear cut and if you don't pay the money back its theft. You could reasonably have known that the money wasn't yours. Your best chance is to push for some sort of repayment plan. If you don't have it in full I don't see anyway they could force you to repay it in full.
However I believe, for what it worth, the legailties is very clear...Mixed Martial Arts is the greatest sport known to mankind and anyone who says it is 'a bar room brawl' has never trained in it and has no idea what they are talking about.0 -

Yup, that happened to us at work. Payroll ran it twice, we all got paid twice and instead of going through the whole repaying it business, they just didn't pay us the next month. Simples - albeit annoying, although I just put the extra into a separate online saver and 'paid' myself the following month. Sorry to hear of your predicament, but you will have to repay it. Maybe ask if they will take 10% per month until it is paid?

Unfortunately I think you're gonna have to pay this back or forego future wages to redress the balance as this isn't likely to be an overpayment that you could reasonably believe you were entitled to.
I'm not sure of your rights regarding repayment scheduling so I will leave that alone, but I am fairly sure that they are within their rights to seek the return of the overpayment, or at least that is the understanding I've been left with from reading similar threads on MSE and other advice sites.
As a side note I would suggest that checking your income is correct each month is good practice, think of the strife you could be in if you hadn't been paid and not noticed for example?If you think of it as 'us' verses 'them', then it's probably your side that are the villains.0 -

Now if you'd only gone as far as saying you'd been paid twice, that would have been quite believable, but to then say you didn't realise and then went on to spend it really lets your story down.;)
PS. It also helps to stick to regular font sizes as more often than not those posts on this and other forums which change to an irregular font do tend to come from trolls !0 -
