When things you buy break..

and they have to be returned what are the rights on getting a new one?

I bought a new double buggy a couple of weeks ago and the shop have just called me as the brake broke on it and they are collecting it tomorrow for collection, the lady said it will be fixed and returned but won't be until next week. She offered me a refund but tbh i need the buggy asap as look after twins and queried a new one instead. Why after shelling out £80 am i not entitled to a new one in place of this?

    This sounds perfectly reasonable - she has offered you a refund which is fab, you have one of three options

    1) accept refund and buy elsewhere
    2) Ask her if she will just swap it
    3) Accept repair and be without buggy for however long.

    Its up to you what you want to do but i would talk to her as she sounds quite a realistic person :)

    They can offer a repair, replacement or refund (can be partial to take into account use you have had) providing it is not of significant inconvenience to the customer........they can insist on one rather than the other if it is disproportionately costly to them.

    Have you asked for a replacement instead? What was their reason for refusing if you have asked already?

    Why not take the refund and buy another?

    Due to our car it has to be a specific double buggy, this one was a really good price and love it so don't want to (and would prob struggle to) get another one from elsewhere.
    I know the woman is doing her best it's just having twins 8.15-6pm 5 days a week without a buggy is rather restrictive. I asked re a new one and ide send the other back but she said the policy is to check it to make sure i haven't done it?

    I don't have the children today and am sat here day off waiting for them to collect it so hope they show up.
