A bought a external door from B & Q this was a display door and at a reduced price.
I paid the full asking price and was told that it would not be removed until the end of June but would recevie a telephone call. By the middle of July I when to the store to find the door was still on display agreed to wait. I then sent someone over again to collect the door they were told that they didnt have a staff that could not get the door down so again agreed to wait still no phone call. Then had holidays and asked someone to return to the store I still did not have a phone call. However I was told after a 30 minute wait that they couldnt find the door. I then when over myself and was told that they had sold my door to someone else and couldnt replace it as they no longer stocked this door, they would refund my money, I havent done this yet as I dont want my consumer rights to be affected.
Also while discussing what had happened a returned door fell on me scrapping my back after leaving the store I reliased that they had not filled in a incident form howver I do have people who witnessed this and have photo of my back,
What is the best steps to take now.

Your rights are to get a door or get your money back.
Oh... and get down the local A & E Dept and get that back looked at.

I would like door but they say they can not do this as it is no longer stocked. I wouldnt be able to get a new door with the refund.

You should be able to get an ex-display door at that price... if you can find one at that price of course.
You are only out of pocket by the amount you have already paid.
When they broke the contract, their obligation is to put you back to the position as if the contract had not taken place.

they now have no display model on sale as it all new stock I would have been hapy with this. so cannot get a door. I will take this further as I if I took and then sold there belonging i would be arrested for theft.0

tgill, dont waste your time and energy on taking this any further, you will be laughed at and this will just lead to more upset and frustration. Its a case of you win some, you lose some. All B&Q have to do is refund you the money, maybe they will bung in some vouchers for you, who knows, might be worth having a chat with the manager. Other than that, ensure they have filled an accident form in for the door incident and then move on. Sound advice already given so no point in repeating.0

I'm almost certain that this "put you back to before the contract" quote is wholly incorrect. If it was correct, it would be a charter for chancers to sell any old crap, but give a refund if they got a complaint.
Airlines could take bookings and then not operate flights, just giving a refund. Nah, doesn't wash.
Equally, consumers could use it to return any item, regardless of the law and get a refund. e.g pay for an item, then cancel the payment, take the item back and say "well, you're back to where you were before the contract."0 -

Under English contract law they are obliged to either :
fulfill the contract
put you in the same position had the contract been fulfilled
You are entitled to find a similar door and sue for any difference in price.0
