Pole Dancing Annoyance!

hi, this is a little random but hope someone can help me!

basically i paid for a six week beginners pole dancing class for £90 the amount was paid up front, i passed this class and on on the final night the instructor mentioned an intermediate would take place shortly. they contacted me the day the before the intermediate class started and like last time i paid the £90 up front for another six week course. i could not make the first class as i was away, however when i attended the second class i was the was the only one doing intermediate, and had been tagged onto another beginners class.

i spoke to the owner of the company and explained i wasnt happy about this and would happy to attend another intermediate course at another time when there would be more people attending - she has since told me she will not give me a refund but will hang onto my money for when i want to go back to the classes at another time - not happy and really want my cash back!

can she hang onto my money?? i havent signed any contracts. id appreciate any help!

    No she can't. There is a contract, although it is verbal. It looks like you paid on the strength of an intermediate course starting on a particular date. So the bottom line is that the money is due back to you or they should offer a reasonable alternative. Hanging on to your money without giving a date for a course is not reasonable.

    It did though and she missed the first one... Thats how i read it anyway. And then got put back with the beginners and has now been offered a new course in the future..

    Im not sure where you stand but as the course had started and you missed the first one it could be fine for them to hold onto it.

    No, missing the first night is not that relevant. OP could reasonably expect to continue from second night - certainly no justification to hold on to the money without offering a specific date for a new course.

    I'm guessing that when they put on the intermediate course they were banking on getting sufficent numbers to run it as a separate class. There was probably a good chance that it didn't become apparent they didn't have the numbers until that first week when you weren't there. You missing that first night isn't relevant...unless there's a stack of other intermediates who also just missed that first night they'll not have the numbers so won't put on 2 classes. That in itself is understandable but to not give you your money back isn't acceptable. You paid for intermediate and now can't do the class you wanted to do, so you should get your money back.
    Just one word of caution...I do dancing (belly, not pole) and that happens with us sometimes, where the numbers have been a problem. I've always carried on going anyway. A decent teacher should still be able to let you advance. If you stop altogether then try for an intermediate in a few months time you'll be out of practice - 6 weeks isn't really that long and if you were to try another intermediate class elsewhere you might find yourself somewhat behind others who will have been dancing longer
