  • Accepting a repair of a defective item doesn't necessarily negate your right to a refund should the item fail again (although it is wise to state to someone at the time that if it fails again, you want a refund) - according to my textbook, anyway.
    does anyone know where i stand if it ends up going to court(will i end up having to pay court charges if i win or lose ?)
    It should go to Small Claims Court (due to the amount). Although it is theoretically possible for a magistrate to award costs against the claimant in this situation, this is exceptionally rare and only normally done when the claimant is being vexatious (according to a law professor) - normally, you pay your court fee (£80 max), which the defendant then pays if you win, and that's it as far as costs are concerned.
    contact consumer direct tomorrow to find out where i go from here in regard to comet not responding to my letter.
    They will probably tell you to issue a small claims summons. You may find that Comet ignore the letter, hoping you'll "chicken out" and go away - sometimes when confronted with a summons, companies just pay out as it's cheaper for them. Alternatively, should it go to court, you may find they simply don't show up, in which case a default verdict will be entered against them.
  • I'd suggest that registering the machine and getting the indesit engineer out can't do any harm.
  • Comet seem to buy out warranty from Indesit /Hotpoint. So I suggest you call customer services at Indesit and ask for a proper Indesit Engineer to comment.

    fre55die in response to your 2 posts the first time the washing machine developed the faults mentioned in my previous posts i actually did contact indesit to register the washing machine and to get a proper indesit engineer out and soon as i told them the washing machine had been purchased at comet they straight away told me i would need to contact comet to get a comet engineer out because comet are responsible for the first years maintainence of the machine not indesit

    hi folks after sending comet a 2nd sale of goods act letter last week by recorded delivery they finally responded to the 2nd letter by contacting me by phone today at 1430 to let me know they were calling in response to my letter and basically told me they were not prepared to authorise an exchange/replacement/refund and they were only prepared to offer me a repair because its only a minor repair. i told them the machine has become faulty once been repaired once and become faulty again for a 2nd time all within the space of 4 months (faulty door lock on both times) and i was not prepared to accept another repair i have contacted consumer direct and told them comet contacted me today and i explained to them what comet said to me on the phone today. they have passed the case on to my local trading standards office
  • hi folks good news!! comet sent me a letter to take to a comet store to exchange my old machine for a different model (they gave me back the £199 i had paid for original washing machine)and i put that towards a hotpoint wmd962p 1600 8kg machine (£329) and collected from store and i used a voucher code i got off the net in store which brought the price down to £313.55.comet are coming to collect the old washing machine this weekend. hopefully this machine will be better than last one. ill never use comet again though and would recommend everyone to avoid them like the plague
