SPML Can I get some help please

Hi everyone

I have a mortgage I think with SPML. I was unlucky enough to be advised to take a mortgage with these sharks back in 2005 and they have made my life hell ever since.

I make the payments to mortgage every month at my local barclays branch and for some reason at least once or twice a year a payment will going missing or take a few extra days being paid into my mortgage account.

I have complained to both barclays and to SPML but don't get anywhere and they never say why it has taken them more time than normal to process my payment

I have had it to my back teeth with the charges and fees and want to strike back. Last year they took me to court and an arrangement was agreed and a suspennded repo order was given

I came across something this

THE FOLLOWING IS OF VITAL IMPORTANCE TO ANYONE WHO HAS A SUSPENDED REPOSSESSION ORDER WITH SPPL or SPML.

UPON SUBMISSION OF SPML’s ACCOUNTS FOR OCTOBER 2009 THEY ONLY HAD 45 MORTGAGES.
THEREFORE ANYONE WHO HAS HAD A SUSPENDED ORDER GRANTED BY A COURT IN FAVOUR OF THE LYING SCUMBAGS SHOULD IMMEDIATELY MAKE AN APPLICATION TO THE COURT USING THE ACCOUNTS AS EVIDENCE THAT THERE IS A VERY HIGH PROBABILITY THAT THEY HAD NO RIGHT TO BRING THAT CLAIM.
The same applies to anyone who has faced litigation from SPPL. They have had no mortgages SINCE 30th NOVEMBER 2008. Any repos in the last two years are almost certainly unlawful. Someone should make an uber complaint to the Civil Justice Council about this DISGRACEFUL ABUSE OF PROCESS AND DELIBERATE DECEPTION OF THE COURTS.

USE FORM N244 TO PUT THIS NEW EVIDENCE BEFORE THE COURT AND ASK THAT THEIR CLAIM BE STRUCK OUT AS AN ABUSE OF PROCESS. MORE HELP CAN BE FOUND HERE IF YOU WISH TO DO THIS.

can someone explain this to me and tell me what to put on the n244 form

Its on the site you copied this from.
  • I am a very apprehensive about posting there, so asking for help there is a complete no no.

One guy has an Eminem wanna be complex, another guy just seems to be his yes man and a "woman" just appears to have a lift that does not go to the second floor of a ten storey building so forget about it going to the top floor.

Besides it looks like only 3 or 5 people actually post there and paranoia is out of control.

So I thought it best to come here

I would suggest you make an appointment with your local CAB and ask them to help you.
  • Appreciate your advice, I will give CAB a call first thing Monday morning.

Guessing by your comments the N244 route is a non starter.
  • That site is run by a bunch of spamming idiots !!!

I think you need to sit and discuss your own individual circumstances in detail. SPML are notoriously bad at "administration". There have been instances where people have sucessfully recovered fees levied for example. So would neither like to build your hopes up or say you had none.

So much better when someone outside of the situation and give impartial unbiased advice.

As a customer of SPML/SPPL/Capstone mortgage services since 2006 and also found myself in the same situation as you not that long ago and kindly SPPL took me to court and also got a suspended repossession order. Unfortunately they have a very bad reputation for dealing with their customers, so it is a waste of time phoning them unless you are prepared to deal with some abusive, patronizing and absolutely clueless advisor, who will then put you on hold for an hour on a premium rate number (thats how they make a bit of pocket money out of you) so I would suggest writing instead.

But as I also found out don't hold your breath when you ask them to refund charges etc, because they will say no! They will also tell you that their charges are fair which is laughable seeing as they charge more than Kensington and Gmac and they were both fined. So my advice is get them to send you a final letter saying that this is all they can do, then you can report them to the FSO for unfair charges and whatever else they have done to you. Hope everything goes well, and you get your money back. Take care LMS
