hi ive got 13000 grands worth of unsecured debt im unemployed but was given credit whilst on dla now its been stopped so im up the creek ive been to cab theyve wrote to my debtors but ive just had a call from a solicitors acting for one of them telling me they gonna take me to court and get the money owed taken off my benefits can they do this i was rather rude to this idiot as he was very rude in talking to me cab advised i go bankrupt as i have no assets just got to save the 325 quid up any help appreciated

What exactly do you want the help with? The call, the debts or the money to go bankrupt?

I'm not sure I understand your situation, 2 litre. Is your only income from benefit? And are your creditors looking for an order to receive money directly from your benefits? I doubt that's possible, unless the creditors are themselves benefits agencies looking for repayment of overpaid benefits.
It may be worthwhile for you to post directly on the Benefits board as posters who work for the various benefits agencies visit the board and can give informed advice. It would help if you could state what benefit(s) you receive, whether that is your only income, and who the creditors are that are seeking a liability order from you.
If it's your bank swallowing up your benefit in charges, then someone posted wording the other day on the Benefits board that you can quote at them along the lines that benefits may only be used for the purpose they were issued. i owe my bank on credit card and a loan got 2 other credit cards whilst i was claiming dla my dla was stopped hence i cant pay/wont pay loans and card i get income support and thats it i got a phone call from some idiot saying they were going to take the money i owe from my benefits at which point i told him to go forth hope thios explains better i will mosey over to the benefits board thanks fo the replies0 -
Thanks, 2 litre, I'd be surprised if non-essential creditors could get a liability order from your IS. Even if they did, it would be at a rate of £1 a week or some similarly low amount. Please go and see the CAB for advice on what you should do next.

In my experience, I've never had a solicitor acting for someone else ring me up threatening me with this & that. I'm almost sure that a genuine solicitor would write to you explaining their actions. Judging by the rudeness you received on the phone, it's my guess that this was in fact a DCA trying to scare you into offering more than you can afford to pay. Next time they ring, request that they communicate with you in writing only & tell them that if they keep phoning then they will be reported. In the meantime, contact either CAB, CCCS or Payplan & get some proper advice as to which is the best way forward for you.Donedoingdebt Lightbulb moment January 2000. Debt at highest approx £102,000. On the papers sent to me by CCCS, the following information might be of some use:
Office of Fair Trading Guidence on harrassment
A creditor Must NOT:-
a) Bring unreasonable pressure to bear on a customer in default of payment
b) Every effort must be made to settle the account satisfactorily
c) Falsely claim that criminal proceedings can be brought for non-payment
d) Falsely imply that you may legally seize property or take other action without going to court
e) Compel the signature of documents, which allow repossesion of goods
f) Impersonate a Court or any other official person, by letter or by telephone (A solicitor is in this catergory)
g) Contact the customer at work or the customers employer with intent to create embarrasment and fear of dismissal
h) Wait outside work on pay day
i) Call on neighbours, pretending to believe they are the customer
j) send insufficiently addressed postcards (???)
