Since moving in i've spoke to the surrounding locals and have been given some more information:
The porch was built 15 years ago by a professional builder, at that time, no objections were raised by my neighbour and his then wife, 3 years ago, his wife died, and since then he has had a problem with the porch. The previous owner refused to sign the agreement, and lived here for 2 years. The neighbour said he was going to build onto my house at the back if it wasn't signed, but the previous owner denied him permission to build on the wall.
The neighbour came around again today with a new 'Document' he said his son currently owns 50% of the property and upon his death, his son will inherit the property, his son has apparently gone to the solicitors and had another agreement drawn up (I have my doubts, theres no letter head and some syntax problems, ill type it as it appears) and given me 3 copies, I've told him I'm going to have it checked over before doing anything.
It reads as follows:
On this day of ________________
I, (neighbours name removed) of (neighbours address removed) Will agree to end all opposition against the attached porch which is attached to my property, with the agreement of the owner of (My address removed) ,That he would be responsible for any damage made to the interior part of the porch wall of which it is attached to, and not to extend it any further than it is at present without prior consent,
Also with agreement with the same owner that I have the same privileges to the rear of my property to (My address removed), external wall that I make make fixings to that wall.

I noticed this has been amended 'interior part of the porch wall' and that there is now a clause to say he can build.
Any further advice on this?0 -
there is no need for you to sign anything here and he clearly has some agenda, if he wishes to prove that your porch is illegal then let him try and if and when he can prove that take it from there, i wouldn't sign something that made me liable for something built by someone else in the past!This is a system account and does not represent a real person. I've not read every post in detail but did you ever take legal advice on the issue as advised by various others? If not then do it now. Check for cover on your home insurance, if nothing else they should be able to give advice.0

I was trying to get advice from my conveyancing solicitors, but they're hard to get hold of, luckily I took out legal cover as part of my home insurance, and they are going to get back to me this afternoon with some advice.
Additionally, I've arrange a chartered surveyor to come over and advise me, and if appropriate, my neighbour, as well as writing a letter to my mortgage companies cheif office dealings team.0 -

Legal advice would seem sensible as your neighbour appears to be taking advice from a Bar Room Barristor......................I'm smiling because I have no idea what's going on ...:)

in all seriousness, what exactly are you getting legal advice for? you are paying these people to come and do inspections/write letters etc, it is up the guy complaining to prove that this porch is illegal, after that has been established or rubbish would be the time to start getting people involved! you are paying for what the neighbour should be paying for!This is a system account and does not represent a real person. As others have posted, this guy has had an agenda for 3 years and, having failed to get your predecessor to cave in, is trying it on with you.
If he's got a problem with the legality of your porch then he should be contacting the council. Frankly I can't see how he'd be able to get that through. By all means take legal advice but only in order to protect your position and to be able to tell him where to go. I don't understand why your mortgage company needs to be involved or why you need to go to the expense of a surveyor.
And you certainly shouldn't be giving away your own rights over your own wall as a result of some ineffective manipulation / blackmail.0 -
Hi all,
Just to say thanks to everyone who supported me on this issue, I was frank with him and told him I won't be signing anything, if he has a problem with it being there he is welcome to take it further but since I didn't build it and it was there so long without issue, I'm not signing.
I've said if at any point he wants to do similar at the rear of his property, to approach me with plans as and when he wants to, and I will be receptive to work planned and done properly.0
