Tax Credits: appealing stage

Hello,


I was following some threads about tax credits.
After applying for working tax credit my husband that works about 40 hours and myself unemployed; we received a letter meaning not eligibility, with a month period to appeal and to contact them by phone before to write a formal appeal.


We tried to work out about the reasons why we aren’t eligible (apparently due to income). But having read all information on internet, doing the online simulation and considering our personal circumstances we are sure we are.


After that I thought I could receive some advice or orientation from the CAB, but I was left extremely disappointed after waiting for 2 hours just to talk with lady for about 5 minutes, taking some details and signature and leaving us for 15 minutes waiting just to receive a sheet printed from internet and telling us that we have 1 month and we could call the tax credit helpline.(She said she was not specialist)


I wonder if someone could advice. We tried to call the tax credits and we are just spending money trying to reach them. I thought to send a letter (no formal appeal), exposing my circumstances. I read around, I could also call from the HMRC enquire centre. Is this possible?


In the meantime I received another packet with the form on it. Probably they sent it by mistake? In any case I have to reply to the address in the letter which states the decision. Or by any chance do I have to resend the application to the initial address?


Would it be already a formal appeal if I send a writing letter exposing my own circumstances and asking for the reasons they think we are not eligible?



We have no kids we are over 30 years old.
My husband works 40 hours, receives the basic salary plus commission when eventually reaches targets.
P60 total was less than 20000 2009- 2010 paying student loan, mortgage, commuting (almost 120 miles to go and come back from London) and supporting me,


I am back in UK since February, looking for employment.
we don’t receive any benefit
However I eventually could be working part-time for this Christmas period.


Based in these details is there clear reasons that we are not eligible to get tax credits benefit?
When we sent the application, we didn’t insert additional documentation.
Any comment will be greatly appreciated.

    yes, your husband earns to much to be eligible, the cut off for WTC for childless couples is around £18k
    they will not take into account any debts or other outgoings...

    Did you or your husband claim?
    Are either of you subject to immigration control?

    Have you filled out the HMRC Tax Credits Do I qualify questionnaire on the HMRC website?
  • We claimed as a couple, because they said we should do it like that, as we are married and live together. My husband is the responsible. he appears as a "you" and myself "your partner"

    we are not subject of immigration control.

    and I was sure the income between 2 is higher than 18 K
    and considering that wages are variable depending on reaching targets.

    so my husband did the claim adding my name on it.
    and yes I have done this online and it shows eligibility for tax credit

    masha.........just because you dont like the fact that your husband earns too much to get tax credits doesnt make it any the less true!

    if i were you i'd redouble my job hunting efforts as it is the only way to increase your income.

    thanks for the link, I had forgotten about this table. That is true, I'v seen it -probably the same table- when I discovered about tax credits and I thought we were eligible.
    because doing the "do I qualify" online it was confirming we could do it.

    I came here to receive some orientation and understand a little bit more about this. it's not about something I like or I don't like. ultimately just me and my husband -and probably God- know our personal circumstances and the efforts we have been doing.

    Hopefully things will be better and for everyone.
  • Is it right that you have to wait until next April to recieve any award you may be entitled to just in case your circumstances change inbetween now and then?
