evidence for housing office of non compliance of deposit schemes

I am writing to the housing department in response to the tenancy deposit schemes and non compliance, as they believe this legislation is working for the good of the tenant, on reading this blog I feel that I am not the only one whoose landlord failed to protect the deposit or was very late in complying. I am trying to find out why the DPS are allowed to have no initial requirements and allow late compliance thus rendering this legislation useless
