Best way to deal with goods that ive bought that have not come.

I have order some goods at the start of Sept and they still have not come so what is the best to go round it as i have sent a few messages about it to the person and they say to leave it 3 weeks as royal mail wont do anything about it till after the 3 weeks even that he has not send them tracked just prove of postal.
What is the best way to sort it out as im getting close to asking for a refund.

Forget ebay, it is complicated.
