Refund on multipack items?

Ive got a small problem, not a high value issue, but not sure what my rights are..
I bought a pack of two items, Ive worn one, and came to wear the second but found it faulty (overlocking in the seams did not catch one side of the material)
I took both back to the shop, with my reciept, but was told that as one was not faulty (and I had worn it), that it was not possible to refund me, even though the other was unworn and faulty.
I suggested just swapping the faulty one with one from another multipack, but they said they couldnt split sets. I also suggested they just refund half the cost and I keep the one ive worn, still not possible. Due to the barcode they could not refund half the cost.
As I say, they are not high value items, but I was just surprised that they would not entertain a refund for one or both, even though I had a reciept, and they agreed one was faulty.

You are being fobbed off! I would go back and ask to speak to the manager. Where was the item bought? Been smoke free for 4 years!! :beer:0

The two items are in effect one
If it is faulty you are entitled to a refund
You have to return the two original items in the packaging if you have it
Go back and tell them they are breaching Sale Of Goods Act
Good luck"Very funny, Scotty. Now beam down my clothes."
All truth goes through three stages. First, it is ridiculed. Then, it is violently opposed. Finally, it is accepted as self-evident.0 -
As already said these two items have been sold as one unit, therefore as a pair they are BOTH faulty. faulty goods can be replaced or refunded, worn or not. YOu need to go back and talk about the sale of goods act. Store managers hate those words...0

as has been said take them BOTH back and you are entitled to a refund. They SOLD it as a set - part of the set was faulty so THE SET is not fit for purpose (SoGA) and you are entitled to a full refund (and an apology for them not dealing with it properly in the first place IMHO).Don't put it DOWN; put it AWAY"I would like more sisters, that the taking out of one, might not leave such stillness" Emily Dickinson

Thanks for replies, as everyone is of the same opinion, that makes me more confident that I should get my money back/replacement. I will go back and try and be more assertive.;)0

I expected this to be a case of complaining that they wouldn't refund one as you hadnt taken the other back. Surprised that the store is trying to come up with such a rubbish excuse for not refunding when you took back exactly what you bought!
+! Vote for naming the retailer0 -
It was from Peacocks:o.
Im embarased to say really, as I know sometimes people get slammed on this forum for this with comments like 'well what do you expect buying from a carp store like that' etc. So thats why I didnt really say to start with.
The point for me is that all shops in theory should have to follow the same laws. Just because I have to be careful with my money and buy from 'cheaper' shops, should not mean that I no not have the same rights as someone who can afford to shop at more expensive shops:o. The item saw obviously faulty, but it was the 'multipack' issue that seemed to throw them, and an issue I'd not come across before.
Mynameisdave..Yes, I took both items back, but when they refused to accept both back, thats when I suggested the other options, to keep the pair I had worn, as that seemed to be the sticking point.
Anyway, going back tomorrow, hoping to drag my OH too for moral support!0 -
It doesn't matter if you bought something from Poundland or Prada... the law is the same! Just because something is cheap doesn't mean you shouldn't get a refund/replacement if it's faulty.
I hope you get what you want tomorrow and an apology for being messed around in the first place! Been smoke free for 4 years!! :beer:0 -
While i wouldnt expect a £10 top to last as long as a £200 top......i still wouldnt expect it to be faulty from day 1.You keep using that word. I do not think it means what you think it means - Inigo Montoya, The Princess Bride0
