Just thinking aloud about your joint overdraft ... if you are only paying token amounts, is there additional money that you could put towards clearing the joint overdraft?
I don't know whether you are taking your name off or closing the account. Is it worth setting up another basic bank account for bills, so they are protected in case the bank decide to remove the overdraft facility?0 -
Hitabrickwall, you have got some good advice so far. The main thing is, you have told your creditors the situation, so there is no need for you to explain anything else. Do not contact them under any circumstances - if you have to send token payments just quote your ref number and leave it at that. I would send the payment recorded delivery as well, so you have proof of posting. Any calls you get - don't answer any "security" questions, just tell them to contact CCCS quoting your ref number, then say "please do not call again" and put the phone down. Anyone getting cute on the phone, just ask them to hold a minute. At this point put the phone down and leave the room for a few minutes. They will be gone when you get back! When I was going through this my creditors found themselves in all sorts of weird places - on one occasion my knickers drawer in the bedroom! Keep your spirits up by devising new places to put the phone in when they next ring you!
Seriously, though, things will ease up once your DMP starts. The calls might still take a while to stop, as some creditors still try it on even though they get regular monthly payments. Any calls or letters received, forward on to CCCS. You are doing what you can to pay your debts, you can do no more. Repeat after me - "They cannot have what I have not got!"One life - your life - live it!0 -

Thanks all. I have spoken to the cccs. Me and my husband are trying to raise money to pay off the overdraft then my name can be removed from that account
The mbna debt is q credit card. I have it for years. I will ask for a copy of the credit agreement.
I am no longer answering the phone to them but the phone is ringing constantly.
I have written to all creditors twice now explaining position and quoting cccs reference. Thing is it is the combined payments to all creditors I cannot afford so for example when mbna are asking what my monthly salary is I cannot say as they will see I have surplus
I have openEd a new bank account and my salary is now paid into there.

Ok, as they are not playing nice do the same as there may be a good chance here of pursuing the unenforceability route.
If they do not have an enforceable credit agreement you can put them in default and refuse to pay a penny until they produce a vlid agreement.
I don't necessarily advise this as a way of getting out of paying a debt owed (as they can still update your credit file and still phone you but thats the limit of what they can do) but more a way to give you some breathing space and also show them that you're not going to be bullied.
