Moving out - getting our money back

We handed our notice in to our letting agent last week and have got a date for getting our keys back. I have a couple of questions.

Our rent is paid until 17th Oct but we hand the keys back on 8th Oct, does the letting agent have to refund us the remaining 9 days rent?

Also, when we moved in to this flat all the carpets smelt badly of cat urine and were really well worn. We thought we were going to be staying a long time so spent over £300 having new carpets put in paid for out of our own money. On our checklist from the letting agent it says on moving out, if you have pets (we have 2 small dogs) we have to get the carpets professionally cleaned and provide a receipt. On our inventory it says the carpets are stained and well worn. Do we still have to get the carpets cleaned considering they werent done when we moved in and we replaced them ourselves?

One more thing. Since handing in our notice the plug in the bathroom sink has got stuck (its one of the ones you push down). I have emailed the letting agent but they haven't bothered to reply about it. If we leave it will it affect getting our deposit back?

    If your contract ends on 17th of October then no reason why LA should provide a refund if you leave early.

    In relation to stuck plug depends on what it takes to remove it and depends on what type of sink it is as to whether you can unscrew the connections below and push it up.

    As for carpet, IF contract says it must be cleaned and its not then LA is within rights to charge you for it as that was part of the contract in having pets. The change in carpet is a separate issue but assume it was replaced with consent of LA.

    Our issue with the carpet is that the one that was there before had not been cleaned before we moved in so we don't see why we have to get it cleaned before we moved out. And in answer to your question yes we did get permission to replace the carpets.

    Why did you agree to give the keys back on the 8th if you paid until the 17th?

    is the date the AST ends the 17th? if so and you chose to leave early then that is what it is. YOUR choice.

    if they requested you to move ut sooner then that is a different matter

    Our landlord originally gave us notice to be out by 16th October as environmental health have instructed him to do the heating and windows. We have now found another property to move to and the new landlord wanted us in sooner so we had to give notice for our current property.

    sounds like it is entirely your own choice unfortunately, so there will not be any money to refund.

    I've had to do the same thing in the past to get the next property, especially if it is one i didnt want to miss out on

    If you are leaving early you are not entitled to a refund for those extra days. You dont have to hand the keys back early and if you need to store stuff/phase your removals it can be helpful. You can even stay there if you want to clean the other place before you move in.

    If the LL wants access to the property early to do windows/heating so he can get a new tenant in ASAP it might be worth negotiating this with him to get those days. This could be beneficial for him.

    You don't have to clean the carpets, you have to leave them in a state that is as good as or better with the exception of fair wear and tear. As you have new ones in they can't complain about that. Be careful if you didn't have permission from the LL before you did the work though...
