Are you protected regardles??

I have a buyer and I am informing them that by paying by credit card they are always protected etc etc...


is this true?

in their eyes they do not want to send any advance payments without security but I am stating to them that credit card is the security.

Is this correct?

    No they are not always protected.

    It depends on the value of the transaction and the nature of the dispute - and can (from their point of view) be a beggar to enforce.

  • Yes it it's over £100. Refer them to s75 Consumer Credit Act 1974. Ask them to google it for an independent (ie of you) interpretation.

    The effect is to make the CC company jointly liable with you for delivering the contract. If you don't, they can take it up with the CC company in parallel to taking it up with you. (Most CC companies will want the cardholder to exhaust their remedies with you first, though this isn't strictly necessary.)
