overpaid tax credits

can anyone help me i was overpaid in 2003 and have been paying back the small amount they let you pay, me and my wife owe a few thousand pounds, we did everything right, my wife sent away both our p60 s but were payed these big payments nearly all in the one day, my wife also foned them to tell them about the large amounts and was told that they were correct, it turns out that even though we had sent both p60s they put me the biggest earner down as having been payed no wages.

I gather what you are after is whether you have any claim against tax credits for not dealing correctly with the information you provided. You don't say when they started taking the money back, but in any case, did you dispute the overpayment when first notified? If so, did you appeal against any decision to continue taking payments back based on tax credit error? You normally only have a set time to do this, so much can depend on what happened and when, and what you did about it.
So, if you haven't done already, call the helpline and ask tor a TC846 to dispute the overpayment.
At the very least, you could try writing to TCO to explain your position and try to negotiate a reduced sum to repay, particularly if it causes you hardship. Nothing ventured, nothing gained.

"Other options if you can't appeal- You have the right to dispute the overpayment if you think that the Tax Credit Office has made a mistake.
- You can ask the Tax Credit Office to look again at the repayments they've asked you to make if you are having difficulty making the payments."

WE HAVE BEEN PAYING BACK FROM THE OVERPAYMENT AND DID DISPUTE WHOS FAULT IT WAS AT THE START BUT WERE TOLD IT DID NOT MATTER THAT WE WERE OVER PAID AND HAD TO PAY IT BACK EVEN THOUGH WE SENT OUR P60s TO THEM. THE PROBLEM WAS THAT THEY PUT ME THE BIGGEST EARNER DOWN AS HAVING EARNT NO MONEY FOR THE PREVIOUS YEAR, MY WIFE ALSO RANG THEM TO SAY THAT THERE WAS SOMETHING WRONG BUT BECAUSE THEY HAD PUT MY DETAILS DOWN WRONG THEY TOLD HER THAT THE AWARD WAS CORRECT.0
