2 year dispute with Barclays

Hi,

I have an ongoing dispute with Barlcays. The FOS were involved as of January 2010 but they have yet to get to my case. In the meantime I have been receiving letters and phone calls from Barclays threatening legal action.

From reading on here I thought they were not allowed by law to do this and I would like to write to them to point this out but have been unable to find the legislation references. I found the OFT guidelines but I would feel more confident mentioning specific law rather than just guidelines.

Can anybody tell me which sections of which laws are being violated by Barclays when they continue to chase a disputed debt?

Also, during the dispute I have had arrears marked on my credit reference reports. I thought this was also unlawful. Please can you also provide legislation references for that?

    What type of debt is it and why are you disputing the debt?

    Several fraudulent transactions resulted in overdraft charges that spiralled out of control. I told them on several occasions I was happy to pay off the overdraft if they agreed to refund the over limit charges taken whilst the fraud was being dealt with. Also, my card was supposedly cancelled at the start of the fraud investigation yet the fraudster still managed to use it. I'm waiting for those transactions back too. To add insult to injury Barclays added the reserve facility to the account when it was already overdrawn adding hundreds to the debt. I made a complaint to them about that too!
