Could any insurer be this devious?

Previous threads have alluded to my claim against Axa under a mechanical breakdown policy. I made the claim, it was declined, I appealed in detail, I have now received their arrogantly dismissive "final communication" on the matter. Great! Way clear to FOS or small claims court.
Every letter they have sent to me has made it clear that I have the right to bring this to the attention of the FOS. (I assume that's probably a requirement.)
Now I harbour an unworthy suspicion. Could an insurer be taking advantage of this scenario by declining claims on thin grounds, telling their customers to contact the FOS if they don't like it, and THEN relying on the "inertia" factor which guarantees that X% won't even bother or be too intimidated to even try? Qu'elle surprise!!!

Just go for it, if you are certain that the claim falls within the terms and conditions of the policy.
Most companies would actually prefer it, if their policyholders did not go to the FOS, e.g. case fee and damage to stats.
AXA must feel that they are on safe ground to argue their case.The comments I post are personal opinion. Always refer to official information sources before relying on internet forums. If you have a problem with any organisation, enter into their official complaints process at the earliest opportunity, as sometimes complaints have to be started within a certain time frame.0
