Advice needed with ESA claim.

I was incorrectly denied ESA on 07/01/10 and my appeal was heard on 09/09/10. I got the appeal date through in July IIRC. I'm in Preston (Lancs). I'm currently owed just over £1200 if I've done my sums right due to the length of time that has passed since week 13 finished. To be honest it's not been too much hassle waiting the 8 months for my appeal to be heard. My GP issued fit notes without any problem and after the first few work focused interviews, the job centre have left me pretty much alone
I'm not an expert but I think you can reclaim ESA 6 months after failing the medical for the same illness or sooner if there has been a deterioration. You will need a new fitnote I think now0 -
I know this isn't of much help but please visit the Citizens Advice Bureau, they'll get this sorted out for you and I wish you lots of luck

If you don't mind me asking can I ask what rough area you are in. I also won my appeal at tribunal last week and am trying to get an idea of how long it will take the DWP to paying me the money they owe me
It took 9 weeks from the date of my tribunal to receive my back dated money, this was due to a black log and so the wait was not good. It could be different for you. I would phone ESA and ask them if they have received confirmation of the outcome of your tribunal and ask them roughly how long it will take. Bare in mind that i was told it took up to 3 weeks for them to receive the confirmation.0 -
Hi, just a quickie, when did you put your appeal in, because I was in your position and failed the medical. My appeal was sent in Jan 10, and the appeal hearing was unlikely to be heard until at least March 2011 (15 months).
I told them where they could put it, the stress had been enormous. and claimed JSA like they told me to in the failure letter.
I was thinking about claiming again but the medical certificate I have (runs out in Mar 2011) cannot be used as I need a new illness. Besides which if the appeal hearing date is just as long or longer, I don't think I will bother.
The process is a long one, i would have just gone through with it to begin with. I put my appeal in in december last year and my tribunal was 16th July this year. I put up with the stress it caused because i had no other option, i could not claim JSA as i am not fit for work. THe appeals proces maybe long but if you are genuinely not fit for work then it is some thing that most of us claiming ESA has had to do.0 -

They received confirmation of the decision the Tuesday after my appeal. I know because I sent them a copy of the decision by recorded delivery and it was signed for then. I'm due a payment on Wednesday so I'll be right on the phone if I'm paid at the wrong rate0
