  • Whatever you do, do NOT acknowledge the debt until such times as you have established all the details. There is a standard letter floating around this board which you send to the company who have contacted you. I suspect it would be a great help, perhaps someone could post it.

    If you know it's your debt, get them to send you all the details. Only then, make them an offer to repay it. Pay them what you can afford and think how great you'll feel when this last one is paid off.

    Ok....here we go.....

    I just had a truly horrible phonecall with the debt agency bloke.He was so so sooooooooo rude.Turns out we did make a payment 5 years 2 months ago:mad: So we do have to pay it.Natwest are saying they have sold the debt and cannot help us so we must deal with the company:rolleyes:
    Ok so I told him we couldn't afford it,had no money.he said borrow it.I explained we didn't know anyone with that type of money.He said it wasn't his problem.....
    I asked how he could expect us to pay at such short notice~he said he was being generous in giving us 48 hrs to pay.I said over and over we couldn't pay...
    He's sending out written evidence that they own the debt tonight to be with us 2mro...problem is we are going away.He then started saying we obviously had money if we were going on holiday....errr...the family fund are paying as we have 2 disabled babies:o He said it wasn't his problem.
    He told me over and over again to raise the cash within 48 hrs...Just like I told him I couldn't.I got so annoyed and said we couldn't pay it,were they rejecting our payment offer and he said yes.Either pay now or else.
    I asked him what would happen now...he said I was stalling so pay.AGAIN I said we couldn't... so he said....If we do not receive payment within 48 hrs we will review the case and decide on a course of action....!!!!!! does that mean??
    I am in tears,my poor hubby is fuming...we go away for our precious babies bday 2mro after months in hospital.Our first family break and we get this:mad: :mad: :mad: :mad: :mad: :mad:
    Any advice??

    first things first - try your best not to let this get to you and to not let them bully you. if you cannot pay no matter how nasty they are to you or what they say the situation cannot change. there are others on here better equipped to advise you, but i would also suggest trying to contact the CAB, CCCS or payplan for advice legally on where you stand.

    From the general advice of other responses on here, I would ask for documentation on this payment before doing anything. Debt agency people are not nice and will bend the truth (lie)!

  • What a horrid bully. I would get all the paperwork from them including proof of when you made the last payment and speak to the Citizen's Advice.

    Hi,

    Hopefully now you've had that phone call you won't have any more for a couple of days. When the paperwork turns up you can take it to the CAB for advise and work out how much you can afford to pay each month to clear the debt.

    If they do phone again - before the paperwork turns up just say you're not doing anything until the it does - afterwards say you're seeking advice.

    These companies use bullying tactics as that's how they get their money, but remember you can't give them what you don't have. Also, I've found a very useful response to people is "There's no need to be rude" and also "I have stated my position, and there's nothing I can do at this point in time" - doesn't always work, but the rudeness thing often pulls people up short.

    Good luck, and try to enjoy your break - it sounds like you deserve it!

  • Write to them and ask for proof of the debt and payments made including dates and amounts.
    Ask them to contact you only by letter in future.

    Go away and enjoy yourselves.

    The bullying tactics are just typical - I notice he could not give you a realistic answer to your statement that you cannot pay.
    If this is the case then they can take you to court but no court can force you to pay what you don't have - and the debt collectors know this.

    You can get through this - you are better than they are.
