Landlord deduct our deposit unfairly

    Court of Appeal trumps the High Court.

    Is that official terminology?:D

    "trumps" had an altogether different meaning in our home !!
  • Can I ask so Is this decision correct or can it be overturned it was a test case at the high court, I was appealing my decision but cancelled it due to costing issues, it was going to a circuit judge from the county court, can you just go straight to the high court itself. I had a judgement for default on 15th february 2010 without a hearing for an assessment for damages as my deposit was unprotected, but the judgement was not for 3 times penalty or the order to comply which I had been advised would happen, my landlord finally protected it on 22nd February 2010 but we never received any prescribed information we got a solicitors letter with the company name and account number as we were moving out of the property on 3rd march 2010, would i be successfull in claiming 3 times penalty or not as no initial requirements with dps and they accept very late compliance

    would appreciate any help

  • oh forgot to mention claim changed to part 7 claim from a part 8 despite claim form saying it was for the return of the deposit or for it to be put into the appropriate scheme, court were aware that it had not been put in there,as supplied lots of evidence, 2 other judgements with tenancy report scheme, no such thing, and then damages removed off the other judgement and then no transcripts available as court staff forgot to put tape in machine a bit off a mess really for what started off as a straightforward non compliance case, if there is such a thing
