Need some advice please about PCN

I am in a right pickle here with PCN I received or should I say did not receive.

On the 13 July 10 I received a letter from Ealing Council saying that they issued me with a PCN on the 03 July 2010 and that I was to pay £100.

I wrote back and said that I never received the PCN that they issued on the 03 July 2010 and asked them to send a copy or proof.

Today I received this letter and I am really quite angry as I did not receive any PCN and now face court action for a CCJ and have to pay £150. Please could someone advise what I should do as I am so confused.

  • I would advise posting on Pepipoo (that is the name). They have some specialist who will give you the best advice. There are some seriously clever people on here too and many advise on both forums. Good luck.

    First of all, you don't face Court and you don't face a CCJ.

    The procedure with appealing a parking ticket (which is de-criminalised in Ealing so doesn't involve Court) is pretty much as follows:

    1. You normally get a PCN (I know you didn't - they have to prove they did serve a PCN).

    2. You have a chance to informally appeal the PCN (you didn't get that chance).

    3. In the absence of an informal appeal, they send a Notice to Owner (NtO).

    4. You can now formally appeal (you'll need help with that).

    5. If they reject your formal representations to the NtO you appeal to an adjudicator (an informal meeting, not a Court, not a judge, not a criminal offence!). And most cases that go to an adjudicator are found in the motorists' favour.

  • Thank you brom and coupon very very much for your advice and explaining in such detail. I am so relieved as I really thought there was no way out. I mean if I did get a ticket then I would have paid as it would have been my fault but to pay £150 is a hell of a lot of money to pay for something I had no knowledge of.
