Legal Contract

I posted a few days about a scam I had fallen for. Well luckily I managed to cancel my card before any payment was taken.

I received an email from the scam company saying the couldn't get payment. So i said i had cancelled the card and would like to cancel my contract with them. They have come back and said that when I signed i lost my rights to cancel the contract and I am legally bound to pay all money.

Is it legal to not allow someone a cooling off period? I always thought that you had a 7 day cooling off period for any purchase.

Generally you only have a cooling off period when a contract is signed away from the place of business (e.g. in your own home). You also have some rights to cancel/return good under the Distance Selling Act if you buy over the internet, over the phone or by mail order.

Surely though, if it's a 'scam', then they have mislead you or made false claims in the contract, in which case since they have breached their end, you can break it. It'd be helpful if you supplied some exact details so people here can advise you properly

    What exactly was the'scam'
make the most of it, we are only here for the weekend.
and we will never, ever return.
  • Holiday membership scam, Worldwide vacations. They seem to of been around for a while doing the same stuff, sign up and then you can’t ever get a holiday with them. I signed it at their leased offices I am not bothered as I know they won’t take me to court, but would like to be able to just put it to bed as soon as I can.

Its not a scam as such, you can get a holiday, eventually, you just cant get the holiday you want, and not necessarily where you want
but the holidays are there, misleading for want of another word but scam is a bit storng.

  • When I got home after signing the contract I did some research on the company googled worldwide vacations heckmondwike and found all manner of bad stories.
Stuff like people can’t get the holidays, none of the hotels have ever heard of the company, the office location is supposed to be heckmondwike but in the booklet I got it says Blackpool. Equally on the booklet I got they have photoshoped a sign on the building that isn’t on the actual building. The standard of production is poor and generally for a company that is supposed to be so good and big is producing crap and misleading information. The company has no trading history but we were told in the meeting that they had been up and running for 7 years. This to be is misleading if they had said we have only been trading for a few months I wouldn’t of trusted them and wouldn’t of signed.
I feel that what they told me in the meeting is misleading and wrong and so that is my reason for pulling out of the deal.

People leave themselves wide open to be 'scammed'
Next time google the company before signing anything. I cant believe that people dont do this, when possibly thousands of pounds are at stake.

Same as someone buying a cooker, then they go on the internet and find it £100 cheaper elsewhere, they moan about it and ask for help in getting the £100 back.

Once you have bought something = stop looking.

  • Worldwide Vacations in Heckmondwike are scammers. The people behind the outfit have a track record of setting up scam holiday clubs that quickly disappear after you've paid your money. Premier Vacations and APD Leisure are another two other outfits that the same people are behind.

They set up a website, make some brochures and lure you to their building which is usually a hotel / exhibition centre that they're hiring for a month or two. Then they promise you the earth and lots of great holidays for next to nothing before taking a few grand off you for a three year membership. Then, as if by magic, they vanish and you never see them or your cash again!
