Kaupthing Duplicate Payment

I have just received a letter from the joint administrators of Kaupthing advising me that they made a duplicate payment to my linked account on 7th October 2008 and have requested that I pay it back. I have checked back and this is indeed true . What are my rights regarding this - do I have to pay it back given it was their mistake . If I do need to pay back can I request to pay back over a period of time.

    This is probably not the answer you were hoping for but does it matter what your rights are in this case?

    You know the money isn't yours. People make mistakes. I think that you should return it.

    Of course, if you're in financial difficulty, I'm sure the administrators would allow you to pay over a period of time.

    And amazingly you didn't notice this yourself at the time and for two further years ! Hmmmm, unbelievable !!!!

    You have to pay it back as I understand it, but a request to pay back over a reasonable period of time would normally be entertained if you honestly were not aware you had been credited twice and the amount is such that you are no longer in a position to pay it back in one lump sum (the reason for this being that taking you to court costs them money and time - however, they may still choose that course of action if they are not agreeable to your proposed repayment terms).

    You have to pay it back. There is an actually an offence called "retaining a wrongful credit" (Theft Act 1968 as amended).

    Kaupthing paid me twice in the midst of the chaos 2 years ago. I'm no saint but I was never tempted & I pointed out their error.
